Beijing Comprehensively Promotes Construction of International Commercial Arbitration Center

The Beijing Municipal Bureau of Justice recently hosted a promotion conference to establish the International Commercial Arbitration Center (Beijing) and to conduct a strategic partnership signing ceremony. It was reported from the conference that the implementation of 57 reform measures across 22 categories for the development of the International Commercial Arbitration Center in Beijing have been completed.    

Beijing is enhancing its arbitration-friendly environment by consistently introducing documents, such as Several Measures on Reform and Optimization of the Legal Services Industry Development Environment in Beijing and Registration Administrative Measures for Business Institutions Established by Foreign Arbitration Institutions in China (Beijing) Pilot Free Trade Zone. These efforts are refining policies related to work permits, residence regulations, and entry and exit procedures.

Leveraging its prominent legal resources, Beijing is coordinating a range of dispute resolution methods such as litigation, arbitration, and mediation, while swiftly establishing a comprehensive international commercial dispute resolution framework. Institutions such as the China International Economic and Trade Arbitration Commission (CIETAC), the China Maritime Arbitration Commission (CMAC), and the Beijing Arbitration Commission (BAC) form part of the first group of arbitration bodies integrated into the Supreme People's Court's "one-stop" diversified resolution mechanism for international commercial disputes. This aims to actively foster closer ties between arbitration processes and judicial review. Additionally, arbitration institutions in Beijing are actively exploring strategies for preventing and resolving disputes before they escalate to arbitration stages.

In 2023, the three arbitration institutions — CIETAC, CMAC, and BAC, based in Beijing collectively handled a total of 18,583 arbitration cases with a total subject matter value of CNY 279.207 billion, representing a 46.36 percent increase in the number of cases and a 24.16 percent increase in the subject matter value compared to the previous year. Furthermore, 978 foreign-related arbitration cases were resolved, amounting to CNY 59.291 billion in subject matter value, representing 31.28 percent and 30.36 percent of the national totals, respectively.
