To provide a rule of law basis for the development of the Integrated National Demonstration Zone for Opening up the Services Sector, the Standing Committee of Beijing Municipal People's Congress has promptly issued this Decision.

1. Defining the guiding principles and development goals

The development of the Integrated National Demonstration Zone for Opening up the Services Sector (hereinafter referred to as the "Integrated National Demonstration Zone") shall follow the new development philosophy in a complete, accurate, and thorough way. It shall carry out pilot programs aligning domestic rules with high-standard international free trade agreements, promote the transformation of the opening-up based on flows of goods and factors of production to the institutional openness based on rules and others, and build a good business environment for the high-quality development of the service sector.

According to the State Council's official reply, Beijing Municipality will establish and complete the further opening-up policy system for the service sector that focuses on trade and investment facilitation by 2025 and develop an opening-up system for the service sector aligned with high-standard international free trade agreements by 2030. To fully implement the development goals confirmed in the State Council's official reply, Beijing Municipality will further optimize the business environment, enhance the competitiveness of various industries, conduct effective risk control, and take the lead in establishing a service sector opening-up system that is in line with high-standard international free trade agreements.

2. Promoting the opening-up in key industries and focusing on the development of key industrial parks

The Decision specifies key industries to be developed in the Integrated National Demonstration Zone for Opening up the Services Sector. It stresses to focus on industries for services in technology, digital economy, digital trade, finance, Internet information, business and trade, culture, tourism and sports, education, healthcare, professional fields, aviation, and others. The "Bringing in" and "Going Global" of the service sector will be carried out steadily. It aims to further deepen reform and expand opening-up

Beijing will emphasize the focus on key industrial parks to highlight the characteristics and industrial strength of Zhongguancun National Innovation Demonstration Zone, Future Science City, Huairou Science City, and other key industrial parks, introduce and foster quality projects that meet the industrial parks' positioning, and explore institutional innovations in industrial park upgrading, management system, operation services, and system and policy development.

3. Creating a good development environment for the Integrated National Demonstration Zone

Beijing Municipality will optimize the supply of factors for the opening-up of the service sector and form an institutional innovation system in line with international standards.

Factors of production shall be allocated and utilized effectively to full unleash the market vitality of funds, data, technologies, land resources, talent, and other factors. Beijing will promote a smoother cross-border capital flow, encourage the transformation of technological achievements, guarantee reasonable use of land for major projects, and boost the reform to guarantee international talent services.

The development of the Integrated National Demonstration Zone shall be coordinated with the effort of building Beijing into an international center for innovation and a model city of the digital economy, the supply-side structural reform, and the Beijing-Tianjin-Hebei coordinated development. The construction shall also be in alignment with the development of China (Beijing) Pilot Free Trade Zone. Beijing will strengthen exchange and cooperation with other provinces that have conducted comprehensive pilot programs for further opening up the service sector.

Beijing will establish more open, transparent, standardized, and efficient market access and exit mechanism for market entities and optimize foreign investment service management, as well as the whole process of supervision and regulation. More accurate and effective supervision and regulation will be applied to new industries and new forms of business. The city will optimize recurrent enterprise-related services and build a world-class business environment that matches the strategic positioning of the capital.

Beijing will establish an investment promotion working mechanism and make innovations in investment attraction modes. Specific working mechanisms for the coordination, one-to-one services, government-enterprise cooperation, and supervision and evaluation will be set up for major projects to establish a stable, fair, transparent, and predictable investment environment.

Beijing will make full use of its judicial resources, such as the Beijing Intellectual Property Court, to ensure a good judicial environment and perfect anti-monopoly and anti-unfair competition mechanisms to create a fair and good competitive environment. Beijing will support the development of domestic and international arbitration institutions and international commercial mediation organizations to form a diverse, efficient, and convenient system for resolving international commercial disputes. A professional preliminary mediation mechanism will be set for foreign-related commercial cases and one-stop mediation centers with diversified dispute handling measures will be established to organically integrate mediation, arbitration, litigation, and execution.

4. Defining the responsibilities of government and relevant departments

Municipal and district leading groups and offices of the Integrated National Demonstration Zone are responsible for leading and arranging the development of the Integrated National Demonstration Zone and management bodies of key industrial parks will be in charge of specific matters of the development. The government and its relevant departments shall implement measures in the construction in different phases and appropriate fields and regions, and shall timely summarize and extract the experience of construction and reform of the Integrated National Demonstration Zone and collect practical cases of innovation. Safety assessment and risk prevention and control will be strengthened and security review systems will be implemented. If some of the local regulations in the city need to be temporarily adjusted or are not applicable in the construction of specific regions, the municipal government can submit a proposal to the Standing Committee of the Beijing Municipal People's Congress for further decision-making. If relevant management measures need to be developed in advance, the prescribed procedures shall prevail.
