In accordance with the decision-making and implementation of the CPC Beijing Municipal Committee and the People's Government of Beijing Municipality to further optimize business environment and to continue deepening the reforms to ‘streamline administration and delegate power, improve regulation and upgrade services’, and further systematically optimize the business environment, in an effort to support Beijing in creating a market-oriented, law-based, and international business environment. With the focus on Beijing’s Version 4.0 of Beijing's business environment optimization, this plan is formulated in combination and based on the reform work related to the building of a high-standard market system.
Ⅰ. Major Tasks
(1) Deepening the reform of the access system of the market and bringing down the costs of transaction for enterprises
1. Comprehensively promote the reform of the 'separation of permits from business licenses’.
Together with relevant departments, we will clean up bureaucratic procedures related to operation permits of enterprises in a comprehensive manner, and in accordance with the national pilot requirements for full coverage of the reform of ‘separation of licenses’, releasing the list to the public; enterprises shall not be restricted from entering relevant industries or fields which are not included in the list and thus can carry out general businesses on their own after obtaining a business license. Efforts will be made to reduce the number of required permits and certificates after receiving business licenses and simplify the verification and approval procedures. Before the end of 2021, more than 100 business-related government approval items will be cancelled and replaced by documentation or notifications , and China (Beijing) Pilot Free Trade Zone strives to cancel up to 150 business-related government approval items.
2. Further deepening market entity registration system reforms. We will push forward with the notification-guarantee system for the registration of market entities, explore ways to simplify the documents that need be signed by enterprises in their registration process such as relevant agreements and resolutions, and actively explore the model of the registration. Efforts will be made to continuously improve the integrated online service platform based on 'E-Registration Service Platform for Beijing Enterprises’,in order to strengthen collaborative processing among the departments of taxation, social security, market regulation and others.
3. Constantly provide better convenience for the deregistration of enterprises. We will strive to achieve electronic delivery of deregistration notices, and actively carry out the pilot schemes for the mandatory deregistration of enterprises that have been suspended for a long time but has not been deregistered. Meanwhile, we will ensure proper cancellation process of registration for enterprises that are either bankrupt or liquidated, and create an easy channel for market entities to exit.
4. Continue to advance the notification-guarantee system for items of administrative approval. We will systematically advance the reform of the notification-guarantee system for the items of administrative approval from Beijing Municipal Administration for Market Regulation.
5. For the items of administrative approval, if behaviors that do not meet approval requirements are detected through compliance oversight and the risks can be effectively prevented, the notification-guarantee system shall be implemented in accordance with the requests and guarantee of the applicants. Based on the potential risks of items of administrative approval and the actual work conditions, we will actively pilot notification- system in some regions for certain items and in some processing situations, and include more eligible items into the reform of notification-guarantee system.
Promoting reform of the notification-guarantee system in the registration of advertisement publishing, the issuance of production permits for some important industrial products, the check and approval (recheck) of standard measuring instruments, and the accreditation of inspection and testing institutions.
5. Explore new models for ‘Joint application for permits and licenses’. We will carry out pilot schemes for ‘Joint application for permits and licenses’ reforms for food-related items within the area of market regulation departments, to achieve coordinated one-time submission and approval of enterprises' application materials for business licenses in order to shorten the processing time.
6. Continuously deepen the system reform for market access of industrial products. We will implement the national reform measures on cutting the industrial products-related items of administrative approval and compulsory certification. Efforts will be made to carry out the measures rigorously to adjust the catalogue of products, subjected to China Compulsory Certification, to implement the compulsory certification management system, to increase the publicity of self-declaration of conformity of the enterprises, and to strengthen the supervision of the products in the catalogue and of related certification activities.
7. Pilot the documentation system for food business operations in China (Beijing) Pilot Free Trade Zone. In the China (Beijing) Pilot Free Trade Zone, the approval system for ‘food business operation permits (sales of pre-packaged foods only)’ will be replaced with a documentation system. This system will be included into the reform to ‘integrate multiple permits into one’. Enterprises engaged in ‘sales of pre-packaged foods only’ can submit their documents when they apply for the registration of their enterprise. If the business scope of their business license issued by the market regulation regulator includes ‘food business (sale of pre-packaged foods)’, it is deemed that they have completed the procedure and are allowed to start pre-packaged food sales activities.
8. Fully implement the ‘one business license with multiple addresses’ reform. If a market entity has publicized the actual business premises of its branches or indicated the addresses of its branches on their business license, subjected to the administrative approval of the market regulation regulator, they can go through the approval procedures for the relevant paperwork for its branches.
9. Explore the establishment of a system of one-stop service for foreign investment. Together with relevant departments, we will strive to optimize the service model for foreign-invested enterprises and improve the system functions of ‘E-Registration Service Platform for Beijing enterprises’, so that foreign-invested enterprises can apply for frequently-requested services such as registration, appointment for opening an account, and foreign exchange registration with one-off login, one-off authentication, and one-off materials submission. We strive to improve district-level services ensuring the registration of foreign-funded enterprises can be processed at the "single window" service.
(2) Improve the regulation and law enforcement mechanism and strictly uphold safety to maintain a market order
10. Promote the building of Beijing's compliance oversight system. We will continue to play the role in compliance oversight of the joint meeting office, working together to promote the execution of the implementation plan of Beijing Municipality for strengthening and standardizing compliance oversight, and promote the realization of the regulation responsibilities and addressing difficult regulatory problems in related fields in strict accordance with the principle of ‘the officer granting approval shall also be responsible for regulation.’ Efforts will be made to organize and carry out research and building of a comprehensive regulatory information system to make the compliance oversight scientific and intelligent . Additionally, studies will be made to formulate the opinions of the Beijing Municipality on their administrative inspection work to effectively make sure that their enterprise-related inspections become more standardized and systematic.
11. Continuously expand the scope of the oversight conducted through ‘random selection of both inspectors and inspection targets and the prompt release of inspection results’. Efforts will be made to ensure that the coverage rate the inspections through ‘the random selection of both inspectors and inspection targets’ in various departments is no less than 90%. Efforts will be made to improve the management of the list of law enforcement inspectors and ensure that the law enforcement inspectors who ‘should be included into the list shall be included’. Moreover, we will further expand the coverage of the interdepartmental oversight through ‘random selection of both inspectors and inspection targets and the prompt release of inspection results’, formulate the second batch of items subjected to random joint interdepartmental inspection The items of high inspection frequence, huge interference to the normal operation of enterprises and suitable for joint inspection by various departments shall be included in the scope of the random joint interdepartmental inspection. Except for special industries and key areas, the oversight through ‘random selection of both inspectors and inspection targets and the prompt release of inspection results’ will be carried out according to different risk levels. The proportion and frequency of enterprises to be randomly inspected and the probability of enterprises to be inspected will be correlated to their credit rating and risk level. In doing so, the frequency of inspections and the interference to law-abiding and creditworthy companies will be significantly reduced.
12. Promote regulation based on credit rating. We will continue to implement the (interim) Notice of the Beijing Municipal Bureau of Market Regulation on carrying out credit rating-based regulation, to strengthen regulation based on credit rating, and use the credit rating of enterprises as a reference for the market regulation regulator to implement differentiated regulations. We will also continue to improve the collection and publication of data for enterprise credits, increase the efficiency of information collection, and improve the integrity, standardization, accuracy and timeliness of enterprise credit data.
13. Optimize methods of oversight in key areas. Focus on the areas of food safety and special equipment safety to formulate a list of key items subject to regulation.
We will improve the ‘Beijing cold chain food traceability’ platform, expand the traceability scope to ensure the whole process of the imported cold chain foods can be ‘traced, regulated and documented". In accordance with the work requirements from the Beijing and the State Administration for Market Supervision, and based on the building of the national food industry enterprise quality safety traceability platform, we will promote and guide key eligible food companies in Beijing to connect within the platform, in order to strengthen the management of the accountability, quality and safety of food industry enterprises.
We will continue to carry out full-chain oversight over special equipment, and conduct investigation and rectification actions for the safety hazards of the special equipment in Beijing. In terms of the production of special equipment, we will conduct inspections on the production units that have been reported by customers and is suspected of having unaddressed quality problems. In terms of the use of special equipment, we will carry out appropriate inspections on the units that use the equipment that is identified by risk analysis, inspection of the units using special equipment in public gathering places at least once a year, implement certain inspections on the equipment used in important activities and key projects, conduct follow-up oversight and inspection on certified special equipment manufacturers, and apply the oversight through ‘random selection of both inspectors and inspection targets and the prompt release of inspection results’ of these special equipment users.
14. Guide and regulate the healthy development of the online market. Based on the responsibilities of the market regulatio regulator, we will strengthen the regulation of online live streaming and short-video marketing, and implement the relevant national policies on guiding rules-based competition in the platform economy. Efforts will be made to further fine-tune the List of Responsibilities of E-commerce Platform Operators As Entities, to implement the rules for the regulation and management of online transaction and to step up the publication of policies and the guidance of policy implementation. We will also continue to take action to crack down on illegal online activities in accordance with the law, and relentlessly carry out the pilot schemes for cross-platform prevention and control in the field of e-commerce. By guiding companies to formulate guidelines for self-discipline, we will actively explore innovation in the governance mode for new forms in the internet business.
15. Continue to promote the ‘Internet Plus Oversight’ . Based on the catalogue list of the items under the regulation of national ‘Internet Plus Oversight’ system, we will vigorously adjust the catalogue list of the items subject to regulation as well as the checklist for the implementation of inspection made by Beijing Municipal Bureau of Market Regulation. Continuous efforts will be made to collect data concerning the behavior of the market regulation regulator, regulation targets, law enforcement personnel, and the oversight through ‘random selection of both inspectors and inspection targets and the prompt release of inspection results’, and to ensure the release of early risk alerts and warnings, as well as the prevention and response of risks.
16. Regulate enforcement behaviors of administrative law. Based on the list of powers in Beijing, we will further investigate the items concerning administrative law enforcement in the field of market regulation, and eliminate unnecessary items of administrative law. Moreover, we will constantly exercise discretion in the administrative penalty through the applicable rules of Beijing Municipal Bureau of Market Regulation and the list of impunity of Beijing Municipal Bureau of Market Regulation for minor violations of the market entities, regulate the exercise of discretion in administrative penalties, and continue to improve the work mechanism for impunity and rectification in law enforcement. Efforts will be made to strictly implement the three systems of administrative law enforcement (namely the administrative law enforcement publication system, the whole-process law enforcement recording system and the major law enforcement decision legal review system), strengthen the cross-departmental and cross-field sharing of information, and improve the integrity, coordination and effectiveness of administrative law enforcement through joint law enforcement and comprehensive law enforcement. Additionally, the list of enterprise-related items subjected to the inspection of the market regulation regulator will be sorted out in a comprehensive manner, the system of administrative inspection list will be implemented, and further clarify the administrative inspection standards of the market supervision regulator, with the administrative inspection items, content, methods, and standards to be fully disclosed.
17. Improve the market order. We will carry out special campaigns to regulate enterprise-related transactions in Beijing, strengthen the law enforcement inspections in industries such as power supply, gas supply, highways, railways, and civil aviation, focus on investigating and punishing bad behaviors such as refusing to implement the government-set or recommended price, deciding prices independently or standards without authorization, continuing to ask for payment for canceled items, and blocking the transmission of price cuts, and resolutely preventing tax cuts and fees from being withheld. We will intensify the crackdown on the infringement of trademarks, patents, trade secrets and other intellectual property, as well as on the production and sales of counterfeit and inferior student supplies, refined oil, and auto parts. We will strengthen the connection between administrative law enforcement and criminal justice in the handling of intellectual property cases, and coordinate with relevant departments to publicize the ‘blacklist’ of untrustworthy entities in the field of intellectual property. The ‘iron fist’ approach will be used to investigate and handle cases in the field of people's livelihood, and concentrated efforts will be made to strengthen law enforcement in response to obtrusive problems that are frequently reported and raised by the general public. A case that may pose a high risk on market regulation must be investigated and dealt with and any group of illegal entities must be severely punished as a warning and deterrent for others. Additionally, together with relevant units, we will carry out special campaigns to tackle illegal fee collection of industrial associations, medical insurance fraud, and illegal collection and use of personal information of mobile applications (APP).
(3) Fine-tune basic services of quality technologies, and promote the quality improvement of product and service supply
18. Encourage enterprises to develop advanced international and domestic standards. We will continue to promote the implementation of the policies of Beijing Municipality for subsidizing standardization strategy to support enterprises' efforts in developing advanced standards. The enterprise standards “front-runner” system in which the implemented standards are disclosed by enterprises through self-declaration and evaluated by third-party organizations will be encouraged to promote the continued improvement of the standardization of enterprises. Additionally, the supervision and inspection on the self-declared product and service standards of enterprises will be actively organized and carried out, and Chinese testing standards will be encouraged to be transformed into international standards.
19. Actively cultivate innovation centers of industrial measurement technology. We will serve Beijing’s effort in building the ‘Two Zones’, focus on scientific and technological innovation, the opening up of the services sector, digital economy, coordinated regional opening up and the development strategies of high-end, precised and sophisticated industry, formulating the guiding opinions on promoting the construction of innovation centers of industrial measurement technology in Beijing. With enterprises playing the leading role and the market-oriented environment forged , we will promote in-depth integration and collaborative innovation among diversified players in the field of ‘government, industry, academia, research institute, and capital market", building industrial technology innovation centers, and continuously fostering new industries, new industrial trends, and new models and new services in order to facilitate high-quality industrial development.
20. Explore the pilot schemes of ‘one-stop shop’ infrastructure services. With the focus on industrial clusters, we will guide the appropriate regions to carry out pilot schemes for to test for ‘one-stop shop’ infrastructure service, with integrated measurement, standards, inspection and testing, certification and accreditation and other elements to provide comprehensive quality infrastructure services for enterprises, industries, and regions.
21. Deepen quality improvement actions in a thorough manner. We will fully develop incentives for the award for quality management established by the People's Government of Beijing Municipality, set quality management benchmarks for the industry, and promote models of advanced quality management and share the experiences of award-winning companies. Efforts will be made to fine-tune the defective product recall system, promote the improvement of the consumer goods recall management mechanism at both the municipality and the district levels, and encourage enterprises to fulfill their responsibilities in quality control. We will also leverage the guidance and instructive role of the government, support enterprises to meet the requirements of ‘products sold domestically produced on the same production lines, meet the same standards, and are of the same quality as exported ones' through self-declaration or third-party evaluation, and safeguard the reputation of the high-end quality brands that ‘have products sold domestically that are produced on the same production lines, meet the same standards, and are of the same quality as exported ones’. Additionally, we will further promote green and organic product certifications, and relentlessly advance high-end quality certification for products.
(4) Optimize government services to benefit enterprises, to bring convenience and achieve high efficiency for the public
22. Developing the standardization and normalization of government services provided by the market regulation regulator. We will integrate the lists of regulation as well as the government service items of the market regulation regulator. In accordance with the work requirements of the list of items requiring administrative approval, we will clarify the elements relevant to the items subjected to administrative approval of the market regulation regulator, including the rationality of each item, as well as the departments, conditions for approval, processing procedures, processing time limit, application materials, scope of application, validity period, and intermediary services, in an effort to improve the standardization level of government services. The work for the processing of government service items will be carried out in service halls and service windows. The previously repetitive and unnecessary approvals by the market regulation regulator will be overhauled and streamlined, with various management measures such as the documentation of public announcements, plan catalogues, layout restrictions, certification and testing will be overhauled and standardized, and the implementation of documentation procedures will be normalized to strictly prevent all kinds of fake and unauthorized approvals and actively adjust the government service items of the market regulation regulator. Efforts will also be made to remove hidden barriers, and effectively eliminate unreasonable management measures in the approval and law enforcement aspects of the market regulation regulator.
23. Continue to simplify and optimize the handling of government service items. We will ensure that the online processing of government services applied at the municipality and the district levels will all reach Level 4 (4 included) or above, with the proportion of the requests ‘handled online during the whole process’ at the municipality and the district levels will reach 90% and 80% respectively. Efforts will be made to improve online and offline handling processes, while promoting the contactless delivery of application materials and processing results, ensuring the plans of ‘functioning at just a click-away’ is achieved, such as the data collection of electronic permits and licenses. The whole-process is handled online with the items that need interdepartmental and cross-level processing, the guided integrated package services, ‘service package’ of enterprises and others are fully met there. We will also strengthen the sharing of information resources such as market entity registration and approval results, provide market entities with higher-quality and efficient government services, to effectively deliver a better experience for enterprises.
24. Optimize the application process for policies that benefits the enterprises. For the advantageous policies that enterprises need in order to apply for - such as government special fund subsidies, support for key projects - their application conditions will be set up in a reasonable manner and be made public, with the simplification of the application procedures such as materials and handling process.
(5) Develop their functional advantages in order to serve the coordinated development of the Beijing-Tianjin-Hebei region
25. Further strengthening the collaboration among Beijing, Tianjin and Hebei in market regulation and law enforcement. We will improve the mechanism for cross-regional collaboration for market regulation and law enforcement, build the "1+N" law enforcement collaboration system in Beijing, Tianjin and Hebei ("1+N" means a single collaboration framework for the collaboration in multiple subfields and at multiple levels), and promote the improvement of their capabilities in a regional collaborative governance.
26. Promote the mutual recognition and acceptance of basic quality technology services in the Beijing-Tianjin-Hebei region. We will promote the development of local regional collaborative standards of the Beijing-Tianjin-Hebei region as well as the joint establishment and sharing of the Beijing-Tianjin-Hebei technical specifications for measurement, while formulating and implementing the 2021 action plan for regional cooperation among Beijing, Tianjin and Hebei in inspection, testing, certification and regulation to promote mutual recognition and acceptance of their results.
27. Promote the integration of government services in the Beijing-Tianjin-Hebei region. We will meet the work requirements of the General Office of the State Council for ‘interprovincial processing’ of government service needs, and gradually realize the ‘unified standard for the same government service needs' among China (Beijing) Pilot Free Trade Zone, China (Tianjin) Pilot Free Trade Zone and China (Hebei) Pilot Free Trade Zone. We will promote mutual recognition of food safety sampling results from Beijing, Tianjin and Hebei, and approve application for industrial production permits, including advertising censorship of dietary supplements, and advertising requests for Food for Special Medical Purpose (FSMP) can be processed in any of the three places above.
(6) Continue to strengthen the rule of law and maintain an environment of fair market competition
28. Resolutely implementing the fair competition review system. We will carry out implementation opinions from Beijing Municipality on further promoting fair competition review, increase our efforts in the inspection and supervision of the members in the inter-ministerial joint meeting system for fair competition review and the governments of all districts of Beijing Municipality, in order to advance the supervision and assessment work. We will ensure that newly introduced policies will be carefully reviewed and existing policies will be overhauled. Additionally, the training and publication of the fair competition review system will be increased.
29. Promoting the improvement of laws, regulations and institutions. Based off the realities of the reform work, we will actively promote the adjustment and authorization of relevant laws and regulations in the field of market regulation. This includes the measures of epidemic prevention and control, pilot schemes of reform and innovation , and the effective daily practices that can be promoted over a long period of time which can be gradually institutionalized. Any temporary and obsolete management and control measures will be timely abolished.
30. Continuous efforts will be made to implement ‘Regulation on optimizing the business environment’. We will step up the overall coordination and supervision of the implementation process of reform policies in various business areas, consolidate achievements made in the reform, and promptly detect and solve various problems which can arise during the reform.
Ⅱ. Guarantee for Implementation
(1) Strengthen organizational leadership. We will further strengthen the unified leadership of leading Party members groups over the reform of optimization of business environment . We will also establish and improve the bookkeeping as well as the liaison and coordination mechanism for optimization of business environment , detailing the different levels and divisions of responsibilities, and follow up progresses on a regular basis in order to strengthen the tracking and supervision of tasks and ensure the implementation of reform tasks are carried out. All supervising divisions and offices should strengthen the reform blueprint as well as overall planning and coordinated advancement of tasks, and improve the building of institutions and mechanisms. All divisions and offices should ensure the reform tasks in their own field are fully implemented, and hasten the guidance for the bureaus at the district level. In terms of the reform tasks at the municipality level, we should prioritize overall planning, strengthen communication and coordination with other relevant units, and promote reforms in related fields in an integrated manner. As for district level bureaus, based on the substantive conditions of their jurisdictions, shall carry out the reform tasks of optimization of business environment in their districts through actively exploring and implementing pilot schemes.
(2) Ensure the implementation of policies. We will actively carry out the campaign in which directors of administrative approval departments and public service departments will ‘personally go through processing procedures to find problems’, in order to implement the ‘government service evaluation’ system. They need to pay attention to and respond to complaints filed by enterprises as well as the public so that they can get the service items they apply for processed successfully, and remove any last-item barriers so that the reform can truly benefit enterprises and the public. Incessant efforts should be made to focus on the difficult problems reported by enterprises and the general public, in order to carry out exploration and research to make plans for the next step.
(3) Escalate publicity and training of policies. We will comb through and publish the list of enterprise-friendly policies, as well as releasing and explaining different reform policies via multiple channels, in order to precisely notify policies to enterprises based on their actual needs. We will also summarize and publicize the best practices and reform experiences in a timely manner to create convenience for enterprises and the public to inquire and understand our policies. We will facilitate guidance and policy training for front-facing workers, improve their service awareness and professional skills, and strengthen the interpretation and guidance of policies for enterprises and the public when they apply for government services, in order to give full play to effects of the policy.
