In order to thoroughly carry out the plan by Beijing Tongzhou District Committee of the Communist Party of China and Tongzhou District People's Government of Beijing Municipality on the development of the National Integrated Demonstration Zone for Opening up the Services Sector and the China (Beijing) Pilot Free Trade Zone (hereinafter referred to as the "Two Zones"), and to push ahead the development of Tongzhou District in high standards and quality, the following implementation opinions has been released based on the responsibilities in market regulation and key tasks such as intellectual property protection, registration of enterprises, and law enforcement monitoring.    

Ⅰ. Overall Plan

Firmly stick to the functional positioning of the Beijing Municipal Administrative Center (BMC), prioritize a more favorable business environment and a more inclusive environment for development, strive to build BMC into a demonstration area of business environment, work for the improvement of the satisfaction among enterprises and the general public, optimize various measures to guarantee service and support, upgrade the regulation and law enforcement, and take the exploration of advanced management modes as the leverage to build BMC into a high-level demonstration zone of business environment and facilitate its high-quality development.

Ⅱ. Major Tasks

(1) Serve the key industries in the "Two Zones" and ceaselessly facilitate the registration of enterprises in BMC

First, comprehensively upgrade Beijing Enterprise Service Platform(E窗通) to further expand the scope of application online covering whole process. In addition to the free issuance of electronic business licenses for newly-established enterprises, electronic seals will also be issued to them free of charge, which can be accessed by enterprises at any time through the "WeChat mini-program for electronic business license". Moreover, pilot the "joint application for certificates and business licenses" to further streamline the approval procedures, improve the efficiency of verification and approval, and truly realize that "permits and business licenses can be applied for via a single system and a single application form."

Second, take the lead in the trial implementation of "incorporating permits into business licenses" in the Canal Business District and Zhangjiawan Design Town on the basis of "joint application for permits and business licenses". It means that after the approval of the business license and food-related permits are completed, the information of these permits will be integrated into the print business license in the form of a "QR code". Through the integration of permits and business licenses, each enterprise will be issued with only one business license,which qualifies its business operation.

Third, further expand the service scope and application scenarios of the "Government-Bank Service Connect". Efforts will be made to promote the facilitation measures of the Business Environment 4.0 version in banks, advance the application for electronic business licenses, and the "incorporation of permits into business licenses" in various departments and facilitate the mutual recognition among departments, so that enterprises can approach relevant services in various departments with just a business license.

Fourth, deepen the reform of the food-related approval system. We will carry out the declaration and commitment system in areas where conditions permit, and focus on promoting the "reduction of permits after business license issuance" and optimizing approval procedures. By coordinating with municipal departments, the recordation of enterprises that only sell pre-packaged foods will be included into the reform of "integrating permits into one" in the China (Beijing) Pilot Free Trade Zone. It means that if an enterprise obtains a business license, and its business scope includes "food business (sale of pre-packaged foods)", then it is permitted to sell pre-packaged foods without having to apply for a food business permit.

Fifth, optimize the service for the operation approval of catering stores. With reference to the management model stipulated in the "Management Measures of Beijing Municipality for the Recordation of Small-scale Food Production and Operation Permits (Trial)" for small catering stores, we will further optimize the service for the operation approval of catering stores, and fully stimulate the market vitality. Moreover, efforts will be made to explore the implementation of "pre-commitment and recordation system" for permits application among the catering stores with a gross floor area ranging from 150 to 300 square meters within the scope of the "Two Zones". It means that after eligible catering stores submit the application materials, they can start a trial operation and their approval procedures will be completed within 10 working days.

(2) Serve the creation and protection of intellectual property (IP) in the "Two Zones", and vigorously improve the comprehensive IP strength of BMC

First, the construction of demonstration zones for the IP Agglomeration of small and medium-sized enterprises (SMEs) will be promoted, and demonstration zones for the IP cluster development of SMEs will be vigorously cultivated and recommended. Training and services for patent creation, and hold special training on corporate intellectual property policies will be provided. Additionally, the establishment of an "IP steward" system for SMEs will be promoted to provide them with customized work solutions.

Second, SMEs will be encouraged to implement the national standards of the "Specifications for the Administration of Intellectual Property Rights of Enterprises", and step up the implementation of the national standards. Efforts will be made to strengthen IP financial services and establish intellectual property financing platforms involving banks, insurance companies and other institutions. We will also intensify the publicity of patent pledge financing policies through  patent pledge financing policy briefings and matchmaking conferences, and approaching to enterprises to meet their needs in patent pledge loan financing.

Third, based on the real conditions of the district, as well as the work experience of Zhongguancun Science Park in guarantee insurance for patent pledge financing, we will actively coordinate with the Tongzhou District Science and Technology Commission, Tongzhou District Finance Bureau, and Tongzhou District Office of Financial Services to formulate specific work measures, and propose suggestions for the work of guarantee insurance for patent pledge financing in the district and advance the implementation of these proposals.

Fourth, an IP operation and service system will be built, the mechanism of IP public service centers and public service workstations will be established and perfected. The construction of IP protection mechanisms in emerging fields and business forms will be expedited, and the in-depth integration of IP policies with the ones on industry, technology, culture, finance, and insurance will also be enhanced.

Fifth, we will summarize the work experience from diversified mediation of intellectual property disputes in a comprehensive manner. Based on the real conditions of Tongzhou District, we will implement the upcoming "Litigation and Mediation Docking Mechanisms for Intellectual Property Disputes", actively communicate with the intellectual property protection assistance center of Beijing, and improve the litigation and mediation mechanisms for IP disputes.

Sixth, we will pilot and trial the trademark registration and trademark pledge registration business in the China (Beijing) Pilot Free Trade Zone to provide convenient and efficient services for the enterprises in the zone. Additionally, we will actively connect with the Administrative Committee of Zhongguancun Science Park, strive to have foreign patent agencies set up a resident  office in Tongzhou District, and attract a group of IP professional platforms and service organizations to settle in BMC.

(3) Serve the reform of market regulation modes in the "Two Zones" and create a new paradigm featuring "science & technology + accommodative and prudential regulation" together with enhanced compliance oversight throughout the whole process

First, a remote market oversight and command system of Tongzhou District Bureau of Market Regulation will be built. Its trial operation and expert evaluation is expected to be completed in May, and the system will be officially put into operation in June. Meanwhile, the APP on enterprise mobile terminal will be developed simultaneously to kick off a pilot scheme for its promotion in the catering stores and pharmacies across the region, ensuring that more than 100 large-scale catering stores throughout the year can upload morning inspection pictures and receive work notice on epidemic prevention and control and food safety through the government-business interactive module on mobile terminal, instruct pharmacies across the district to report the daily sales of key drugs in a timely manner.

Second, a legal environment of higher quality will be developed. In April 2021, the "Implementation Opinions for Accommodative and Prudent Regulation to Serve the High-Quality Development of Beijing Municipal Administrative Center" formulated by Tongzhou District Bureau of Market Regulation was revised, with the accommodative and prudent "sandbox regulation" being added into the document, and the "List of Impunity for Minor Violations of the Market Entities in Tongzhou District Version 3.0" being formulated. Before the end of July 2021, the "List of Impunity for Minor Violations of the Market Entities in Tongzhou District Version 3.0" will be revised and improved in accordance with the newly revised "Law of the People's Republic of China on Administrative Penalties"

Third, the fair competition review system will be optimized to tighten the rigid restriction of the fair competition review system, play the role of the joint meeting mechanism of the fair competition review, prioritize the review of new policies and measures, strengthen the review of policies and measures in Tongzhou District, and invite experts to participate in the review process when necessary.

Fourth, the standardization of online trading entities will be strengthened. The 657 entities involved in online trading within the jurisdiction of Tongzhou District will be included into the checklist of "inspection of random inspectors and random targets", and the e-commerce platforms will be included into the key list for the publicity and execution of the measures. Additionally, we will conduct law enforcement work by requesting the entities to show their business licenses, operation permits or the identifiers of the links to the information of permits and business licenses, urge platforms to fulfill their responsibilities as an entity to purify the online trading environment in Tongzhou District.

Fifth, the standards of Tongzhou District for the classification and grading of enterprises' credit information will be analyzed to classify the entities subject to regulation in a fine manner and ensure a targeted regulation with precision. The information sharing between big data institutions and e-commerce platforms will be pressed ahead with in a comprehensive manner so that a mechanism for the whole society to jointly govern the creditworthiness of enterprises will be built, and the integrity of online business entities will be enhanced. We will increase the disciplinary efforts for the breach of trust. Based on the work of "swift response to public complaints", we will explore the establishment of a list of enterprises and practitioners in related fields under special regulation, and implement regulation measures that are corresponding to their creditworthiness.

Sixth, based on the special actions of "dispersion, rectification and upgrading", we will guide the market entities whose development is supported by sub-districts and towns to apply for the business license and operation permits, and to operate in compliance with the law. We will clean up the registered companies with a long period of abnormal operations. Based on the annual reporting mechanism for enterprises, we will eliminate the enterprises that "have not opened for business 6 months after their establishment with no valid reason, or have suspended their business on their own for over 6 consecutive months after their operation" in accordance with the law.

(4) Serve the construction of the "Universal Beijing Resort" project, and make every effort to ensure the implementation of key projects in the cultural tourism area, support the park opening and provide guarantee for its operation

First, a dedicated work group will be set to guarantee the project services for Universal Beijing Resort, formulate the "Work Plan for Service Guarantee for the Construction of Universal Beijing Resort" and establish 7 mechanisms such as regular work group dispatching mechanism, liaison staff assignment mechanism, and door-to-door service mechanism. Through the coordination of the dedicated work group, special research, special personnel assignment, door-to-door visiting, and professional services, services in terms of market entity registration, permits exemption for 3C products, and the approval of brand catering stores will be provided proactively.

Second, a project service package for Universal Beijing Resort will be created to open up a "fast track" for its project approval, take the initiative to provide door-to-door services, establish a fast approval mechanism, and fully realize that "the application can be processed within one-day" and "the business license and permits can be delivered to the doorstep".

Third, importance will be attached to the cooperation with Universal Beijing Resort to provide the list and information of relevant IP to all e-commerce platforms in the district, complete the keyword setting by the end of June 2021, and continue the improvement of such setting throughout the rest of the year. Efforts will be made to supervise and guide the platforms to set IP-related keywords, block prohibited keywords, and ensure the standardized operation of the platforms.

Fourth, the experience of the Universal Beijing Resort in project service provision will be summarized to enhance various facilitation measures, and apply the "Universal service model" to major projects such as the China Green Forest Park, Canal Business District, and Zhangjiawan Design Town.

(5) Serve the integrated and coordinated development of "Beijing-Tianjin-Hebei" and promote new breakthroughs in intellectual property and standardization

First, an integrated IP protection mechanism between Beijing, Tianjin and Hebei, establish a coordination mechanism for IP protection in the three places will be built and then establish a jointly-built and shared service platform for IP protection assistance in the three places, and build an expert database for IP protection assistance to provide professional services for the talents in the region to protect their rights.

Second, we will press ahead with the pilot scheme for the coordination among Tongzhou District, Wuqing District and Langfang City in promoting the standardization of basic healthcare services. Based on the metabolic disorder management model of Beijing Luhe Hospital of Capital Medical University, we will study the standardization requirements of the metabolic disorder management center of the people’s hospital of Langfang City and Wuqing District, and complete the preparation and release of mechanisms like pilot management mechanism, regulation and inspection mechanism, assessment and evaluation mechanism in accordance with the "Plan on Implementing the Pilot Scheme for the Coordination Among Tongzhou District, Wuqing District and Langfang City in Promoting the Standardization of Basic Healthcare Services".

Third, the "Work Plan for Promoting the Integrated Development of Beijing Municipal Administrative Center (Tongzhou District) and the Three Northern Counties of Langfang City", will be thoroughly carried out to actively implement the work tasks specified in the "Key Work of Tongzhou District in 2021 on Promoting the Collaborative Development of Beijing-Tianjin-Hebei Region". The Tongzhou District Bureau of Market Regulation will work with its counterparts in the "three northern counties" of Langfang to sign two framework agreements for market regulation and food safety, and strive to create a synergy by focusing on areas such as interprovincial registration of market entities, exchange and sharing of enterprise credit information, coordination and joint-promotion of food safety, and cooperation in cracking down on market violations. In addition, the collaboration and integration with the "three northern counties" of Langfang in the field of food safety supervision will also be promoted.

(6) Serve the further consumption environment upgrading of BMC and create a safe consumption environment

First, the "2021 Implementation Opinions of Tongzhou District Bureau of Market Regulation for the Work of Citizen Service Hotline in "Processing Public Complaints Without Delay" will be made and launched to intensify efforts to resolve specific problems through study, implement the mechanism of "who are inquired first should be responsible for it", and the coordination mechanism between administrative sections and research institutes, establish dedicated work group dispatching and commanding mechanism, implement assessment and evaluation mechanism. In addition, the cohesive work group in spite of division of tasks, and create a synergy in the work of "processing public complaints without delay".

Second, special actions to rectify irregular operations in real estate brokerage agencies, after-school training institutions, prepaid consumption field, and food and drug safety field will be carried out to facilitate the problem addressing at the source, and fully implement the work of "response ahead of public complainants."

Third, in-depth consumption environment satisfaction survey in Tongzhou District will be carry out to issue analysis on public complaints and release consumption alerts and warnings in a timely manner. Efforts will be made to conduct in-depth investigations and studies on consumer complaint hotspots and complaint-prone industries that are closely related to people's daily life to figure out the current status of the consumption environment and major problems in Tongzhou District, continue to supervise the rectification of companies, and ceaselessly improve the service capabilities and quality of enterprises.

Ⅲ. Work Requirements

(1) Seek for unity and keep the public in mind

The construction of the "Two Zones" represents a greater responsibility given to Beijing by the Party Central Committee in building a new development paradigm, and also an important development opportunity faced by BMC. All departments must seek unity, deepen mutual understanding, keep the public in mind, realize the great significance of the "Two Zones", further enhance the initiative and sense of responsibility in the work, and ensure that remarkable results can be delivered in the development of the "Two Zones".

(2) Speed up the implementation in an efficient manner and with a rigorous attitude

All departments should closely align their responsibilities with the development of the "Two Zones", further heighten the sense of urgency in the building of the "Two Zones", grasp the policy dividend, fully implement each task, strive to remove the bottleneck in the development of the "Two Zones", speed up the progress of the work, prioritize the fulfillment of tasks, and ensure a good start for the development of the "Two Zones".

(3) Create synergy through coordination

All departments should strengthen overall coordination. Led by the Registration Section, and based on the division of tasks among the departments such as Intellectual Property Section, Legislative Affairs Section, Market Regulation Section 1, Consumer Protection Section, Credit Section, Fair Competition Section, Standardization Section, Food Safety Coordination Section, Food Circulation Section, Catering Section, Cyberspace Security Regulation Section, Administrative Office, and Tongzhou District Consumers Association. In addition, all departments should strengthen the communication and coordination with the bureaus and other relevant departments at municipal level, promote the implementation of relevant policies, shoulder responsibilities, coordinate with each other, and strengthen collaboration to form the greatest synergy and ensure the implementation of tasks.

(4) Strengthen publicity and guidance to create a better atmosphere

All departments should take effective measures to step up the publicity of the new measures rolled out by our bureau for serving the development of the "Two Zones" through various channels. We should step up our efforts to provide policy interpretation and service guidelines, and strive to leverage central and municipal media resources to continuously focus on our work in serving the development of the "Two Zones", and conduct systematic and comprehensive publicity using typical cases and from corporate perspectives to build up better public opinion.
