I. Target Scope
Foreign college graduates, including foreign students who have obtained their master's degrees or above from colleges and universities in China and graduated within one year, as well as foreign graduates who have obtained their master's degrees or above from well-known colleges and universities overseas and graduated within one year.
II. Approval conditions
Employment of foreign college graduates in China should meet the following requirements:
(I) Age 18 and above and in good health;
(II) No criminal record;
(III) Good academic performance, with an average score of no less than 80 points (out of 100 points, other credit systems shall be converted to 100-point system) or B+/B (grade system) or above, with no record of misconduct in college period;
(IV) Having obtained corresponding academic qualifications and academic degree;
(V) Holding an offer from a confirmed employer for a major-relevant position. In principle, the remuneration shall not be lower than the average for full-time staff and workers in local urban enterprises, and specific standards shall be properly determined by the provincial human resources and social security authorities according to local employment market and talent introduction needs.
(VI) Holding valid passports or other international travel documents as passport alternatives.
III. Procedures
To employ eligible foreign college graduates, an employer shall apply and provide following materials to the local human resources and social security authority or the administration authority of foreign experts affairs:
(I) Credentials of the candidate;
(II) Offer of employment (including expected remuneration);
(III) A report on the reasons for employment (including the evidence that the local public employment and human resource service agencies have publicly released the recruitment information for domestic workers for no less than 30 days);
(IV) Health conditions certificate of the candidate;
(V) Certificate of police clearance of the candidate;
(VI) Certificates of academic qualifications and academic degrees of the candidate;
(VII) Record of no misconduct in college period (exempted for foreign graduates of overseas colleges and universities) and an academic transcript issued by the candidate's college/university;
(VIII) Front-facing bareheaded photo of the candidate taken within six months.
The human resources and social security authority or the administration authority of foreign experts affairs shall review the applications according to the regulations, and may issue Foreigner's Employment Permit (or Work Permit, the same below) and Alien Employment Permit (or Working Permit, the same below) to eligible foreign graduates.
Eligible foreign graduates of overseas colleges and universities may be issued the Foreigner's Employment Permit. Foreign graduates of overseas colleges and universities who have obtained Foreigner's Employment Permit shall apply for a Z-visa in the first place and apply for an Alien Employment Permit after entry.
IV. Miscellaneous
(I) The Alien Employment Permit is valid for one year for the first time. Upon the expiration of the employment of a foreign college graduate, the employer intending to renew the employment shall go through the prescribed approval procedures for renewal while the renewed employment period shall not exceed 5 years. If the individual income tax paid by the foreign college graduate is lower than the payable tax amount of the intended salary, or the salary proposed by the employer is lower than the prescribed standards, the Alien Employment Permit will not be extended.
(II) The employment of foreign college graduates in China shall be subject to a quota-based management. Provincial human resources and social security authorities shall put forward the quota for foreign college graduates in the province based on the quantity of foreign college graduates demanded by enterprises in the province, employment situation of college graduates in the region and other factors, and submit it to the Ministry of Human Resources and Social Security before December 1 of each year. The Ministry will comprehensively study to determine the quota of the country and provinces (autonomous regions and municipalities) for the next year, publicize the quota appropriately and copy it to foreign affairs, education, and public security authorities for coordinated implementation. The demanded quota for 2017 shall be submitted by provincial human resources and social security authorities before January 31, 2017.
(III) This notice shall take effect on the date of issuance.
