Article 1 Pursuant to the spirit of the Official Reply of the State Council to the Plan for Comprehensively Promoting the Integrated Pilot Program of Further Opening up the Services Sector in Beijing (Guo Han [2019] No. 16) for the purpose of encouraging foreign talents holding permanent residence ID cards (Foreigner's Permanent Residence Cards) to receive national treatment when establishing science and technology enterprises, the Measures are hereby formulated.
Article 2 The science and technology enterprises referred to in the Measures are enterprises engaged in such industries as technology development, technology transfer, technical consultation, technical services, technical testing, or research and development, production, and operation of high-tech products (services) barring industries where special measures are stipulated for market access.
Article 3 The Measures are trial measures to be implemented in the Zhongguancun National Innovation Demonstration Zone, Tianzhu Comprehensive Bonded Zone, Sino-German Industrial Park, Beijing Daxing International Airport of China (Hebei) Pilot Free Trade Zone and Sino-Japanese Industrial Park.
Administrative bodies in pilot areas shall earnestly fulfill their territorial responsibilities, and make all relevant efforts such as honoring the commitments made by the Measures and providing project guidelines. They shall treat all science and technology enterprises established by foreign talents who hold permanent residence ID cards (Foreigner's Permanent Residence Cards) the same as domestic-funded enterprises in accordance with the law and shall not set any discriminatory requirements.
Article 4 In pilot areas, foreign talents can use their permanent residence ID cards (Foreigner's Permanent Residence Cards) as their means of identification to establish science and technology enterprises. They shall receive the same treatment as Chinese citizens holding identity cards as their means of identification.
Article 5 Administrative bodies in pilot areas can, within their legal authority, provide fee reduction or exemption, land use quota guarantee, public services and other facilitation policies for foreign talents holding permanent residence ID cards (Foreigner's Permanent Residence Cards) to establish science and technology enterprises.
Article 6 Administrative bodies in each pilot area shall compile and publish their respective guidelines for investment projects, which must include an introduction of investment environment, investment projects, industries for investment, and business scope, etc. Administrative bodies shall promulgate and interpret those guidelines to foreign talents through appropriate means.
Article 7 Foreign talents holding permanent residence ID cards (Foreigner's Permanent Residence Cards) may register at the local market regulation administration for business licenses if their science and technology enterprises to be established meet the requirements of the investment guidelines in pilot areas.
Article 8 Science and technology enterprises to be established by foreign talents holding permanent residence ID cards (Foreigner's Permanent Residence Cards) can be registered as a sole proprietorship enterprise, partnership, limited liability company or joint-stock company.
Article 9 Foreign talents holding permanent residence ID cards (Foreigner's Permanent Residence Cards) are encouraged to use their own intellectual property rights, proprietary technologies and other non-monetary properties as the capital meant for establishing their science and technology enterprises.
Article 10 When applying for a business license, in addition to all relevant documentation deemed necessary by laws and regulations, applicants must submit a Letter of Commitment to the market regulation administration in accordance with the Implementation Opinions on the Registration and Notification of Commitment System for Market Entities in Beijing (Trial), in which they promise not to engage in business projects that require special measures stipulated by China and Beijing Municipality for market access.
Article 11 Foreign talents who have joined an established science and technology enterprise as new shareholders (partners) that meet the provisions of the Measures must apply to the market regulation administration for a change of registration in accordance with the aforementioned provisions.
Article 12 Owners of pilot enterprises whose domicile (business site) has relocated out of the pilot areas, or whose business scope after alteration no longer meets the requirements of the Measures must go through registration procedures in accordance with relevant provisions of laws and regulations.
Article 13 Foreign talents can use their permanent residence ID cards (Foreigner's Permanent Residence Cards) as valid identification to be enrolled for social insurance in China.
Article 14 Relevant departments of each administrative agency in pilot areas shall enhance internal information sharing, and shall not require foreign talents to provide or submit information that can be obtained through interdepartmental information sharing.
Article 15 The Measures shall take effect on a trial basis from June 1, 2020 for 3 years.
