Highway sub-bureaus,
To implement the guiding principle of streamlining the administration, delegating power and improving government services for the ease of doing business, further reduce the operating cost for enterprises, and improve the efficiency of maintenance project management and make it more effective, we hereby release the following work requirements for the payment of the contract price for ordinary highway maintenance projects in Beijing:
I. Payment of contract price
In principle, the advance payment for the construction contract of an ordinary highway maintenance project shall be made within 14 days after the contract is signed, with a payment ratio of 30% of the total contract amount. Except for special cases, the contractor shall not be required to provide any form of guarantee for the advance payment.
The project progress payment shall be calculated and paid according to the construction progress. In principle, the outsourcer shall settle the payment within 7 days (excluding public holidays) upon the date of receiving the qualified payment application and materials. In general, 88% of the contract price shall be paid, subject to the availability of financial funds.
Upon project completion, the outsourcer shall organize the contractor to complete the compilation of industry data in a timely manner and submit it to the financial authority for final accounting review. In principle, the financial authority shall complete the final accounting review within 30 days after receiving the required materials, and the review results shall be published on the website of Beijing Municipal Commission of Transport in a timely manner.
Upon the completion of the final accounting review and the payment of quality guarantee deposit by the contractor, the contract balance payment shall be paid in a lump sum. In principle, the outsourcer shall make such payment within 7 days from the date of receiving the qualified payment application and materials (excluding public holidays). If the contractor chooses to reserve the quality guarantee deposit as agreed in the contract, the outsourcer shall reserve the quality guarantee deposit when making the contract balance payment.
II. Return of quality guarantee deposit
Upon the completion of final acceptance of an ordinary highway maintenance project and the contractor's payment of the quality guarantee deposit, the outsourcer shall return the performance deposit within 5 days upon receipt of required materials stating the return of the performance deposit.
Upon the expiration of the defects liability period, the contractor shall fulfill all the obligations in the contract, and the outsourcer shall return the quality guarantee deposit within 5 days from the date of receiving the required materials stating the return of the quality guarantee deposit. If the contractor chooses to reserve the quality guarantee deposit as agreed in the contract, the outsourcer shall settle the payment in a lump sum within 7 days (excluding public holidays) after receiving the application materials meeting the payment conditions.
All highway sub-bureaus are requested to earnestly implement the Circular and clarify it in the bidding documents according to actual situations.
