According to the decisions and arrangements of the CPC Central Committee, and the requirements of such documents as the Opinions of the General Office of the State Council on Promoting Government Information Disclosure in Public Resource Allocation (Guo Ban Fa [2017] No. 97) and the Regulation on the Formulation of Standard Guidelines for the Disclosure of Community-level Government Affairs in All Pilot Areas (Guo Ban Gong Kai Ban [2019] No. 1), we have compiled the standard guidelines for the disclosure of community-level government affairs in public resource trading on the basis of summarizing the local pilot results. This aims to further standardize the disclosure of community-level government affairs in the field of public resource trading, and improve the ability to disclose community-level government affairs and government service. With the approval of the Office of Government Information and Affairs Disclosure under the General Office of the State Council, the standard guidelines are hereby issued and relevant matters are notified as follows.
I. The compilation of the standard guidelines for the disclosure of community-level government affairs in public resource trading is an important measure of the CPC Central Committee and the State Council to comprehensively promote the disclosure of government affairs, and also an requirement to transparently manage the whole process of public resource trading and improve the quality and efficiency of public resource allocation. Under the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, all local governments should fully implement the guiding principles of the 19th CPC National Congress and the second and third plenary sessions of the 19th Central Committee of the CPC, and conscientiously enforce these guidelines, with a view to disclosing the whole process of public resource trading, expanding public oversight, extending the duration of disclosure, safeguarding the legitimate rights and interests of enterprises and people, and promoting sustained, steady and sound economic and social development.
II. The term "public resource trading" mentioned in these guidelines refers to the trading of resources that involve public interests and public safety and are of a public or commonweal nature. These guidelines apply to the act of administrative organs at or below the county (district/city) level that perform their duties in public resource trading, or organizations or public enterprises or institutions authorized by laws and regulations to manage public affairs in disclosing government affairs in public resource trading.
III. In accordance with the five disclosure requirements of decision-making, implementation, management, service and results, the guidelines, in the standard catalogue of disclosure, specify 40 specific disclosure items in five areas of public resource trading, namely, construction projects bidding, government procurement, transfer of state-owned land use right, transfer of mining right, and trading of state-owned property rights. Local governments can add additional disclosure items in light of their local reality.
IV. The leading authorities integrating public resource trading platforms at various levels should, in conjunction with the relevant authorities, give full play to their role in guidance, supervision and assessment, improve the system of disclosing government affairs, clarify the review, release and feedback mechanism of disclosure items, vigorously promote the implementation, supervision and coordination, so as to realize the orderly linking of government information release, interpretation and response in public resource trading. Based on thoroughly sorting out and finding out the bottom line, and in accordance with these guidelines, all local governments should promptly formulate or improve the active disclosure catalogue of government information in the field of public resource trading in their respective regions, publicize it on the websites and places of public resource trading platforms, and make proper adjustments.
V. All local governments are requested to collect opinions from all sides during the implementation of the guidelines and give timely feedback to the NDRC. We will revise and improve the guidelines in due course.
