Interim Measures for the Management of New Simple and Low-Risk Small Ancillary Municipal Engineering Projects Involving the Occupation of Greening Resources(Trial)
Article 1 The Measures are applicable to the new simple and low-risk small ancillary municipal engineering projects involving temporary occupation of green space or transplanting or cutting of trees (hereinafter referred to as the "Small Municipal Engineering Project") that are mentioned in Some Provisions on Improving the Examination and Approval Services for New Simple and Low-Risk Construction Projects with Social Investment.
Article 2 Pipeline routing of the Small Municipal Engineering Project to which the Measures apply is determined by the "multiple plans integration" platform of the municipal planning and natural resources authorities through consultation with other authorities.
If a project involves temporary occupation of green space or transplanting or cutting of trees, the district gardening and greening authority shall put forward consultation opinions.
Article 3 After the comprehensive implementation plan of Small Municipal Engineering Project is determined through the "multiple plans integration"platform, if the project involves the occupation of landscaping resources, the municipal engineering enterprise concerned shall take it as the basis to get in contact with organizations owning the property right of the green space and trees as soon as possible.
Article 4 The municipal engineering enterprise shall obtain the consent of the organizations owning the property right for the construction involving temporary occupation of green land and transplanting or cutting of trees, and determine the plan and executing subject of tree transplanting or cutting and restoration of green land through negotiation and agreement.
When it comes to transplanting trees, it is important to make sure the transplanted trees survive.
Article 5 The municipal engineering enterprise shall send the construction plan (including construction drawings) and relevant agreements signed with the organization owning the tree to the district gardening and greening authority in the form of official letter before the project construction (the documents can be sent through the online system when the IT conditions are met).
The municipal engineering enterprise shall publicize the construction content on the site during the construction.
The project can be implemented after the above work is completed.
Article 6 During the construction period, the municipal engineering enterprise shall abide by the relevant laws and regulations on landscaping, and strictly implement the project in accordance with the construction plan and the agreement with the organization owning the property right.
Article 7 In case of illegal use, damage to ancient and famous trees, landscaping resources and ancillary facilities, or failure to restore green space to original state by the municipal engineering enterprise, it shall bear corresponding liabilities and compensate for losses according to the law.
Violations of laws and regulations will be included in the government's enterprise credit assessment system.
Article 8 The Measures shall come into effect as of the date of promulgation.
