I. Main Objectives
This plan is intended to promote reform on core fields and key links, addresses prominent issues, implement policies to ease hardship and benefit enterprises, find the "last mile" solution to policy implementation, refine business environments, and create a world-class business environment that facilitates high-quality development.
II. Main Tasks
(I) Create a more efficient environment for investment and construction
Working on the basis of notification and commitment, we will further reform the investment approval systems, explore innovative investment management models, implement differentiated management according to the project risk level, and optimize the approval process for investment and construction projects.
1. Optimize the approval process for investment projects. First, to efficiently facilitate the administrative processing of "individual item" in the early stages, we will improve the preliminary mechanism for coordination and promotion, formulate rules for reserving and managing major projects, further simplify and integrate procedures for registration and construction of investment projects, and constantly streamline and optimize the approval process, approval operations, and application materials. Second, we will further reform the commitment system for enterprise investment projects in Beijing Economic-Technological Development Area, specifically, standardizing enterprise commitment with unified notification of the commitment content and processes as well as the formatting of the commitment letter, and replicating and promoting the reform of "regional assessment + standardized plot + notification and commitment + supporting facilities by the government" in key areas such as Zhongguancun Science City, Huairou Science City, Future Science City, and China (Beijing) Pilot Free Trade Zone.
2. Further reform the approval for land use. First, we will fit land use into both government and enterprise investment decisions. We will integrate various types of planning data, develop streamlined planning for all base maps at all levels, and realize the base map sharing, real-time inquiry and business collaboration across departments to facilitate the government and enterprise in making investment decisions. Second, we will issue regional assessment schemes to specify implementation and technical requirements for environment, water, and transport. Construction projects within the specific regions will be streamlined by direct admission, notification-commitment system, and acceptance for the lack of part of thematerials. The "neighborhood regulatory plan + regional assessment pilot" scheme will be implemented for approval reform to further simplify the approval process. Third, we will further delegate the planning approval authority, and formulate approval authority lists at municipal and district levels for housing construction and transportation infrastructure projects, to facilitate the application of enterprises and cut the time cost for such processing.
3. Improve the approval system for engineering projects. First, we will implement graded management for construction engineering projects, and streamline and standardize the approval process, technical review and intermediary services involved throughout construction engineering projects. Second, while ensuring safety, notification-commitment system will be established for the permission of low-risk construction, renovation or expansion projects which are financed by social funds. Third, we will comprehensively adopt all-in-one surveying and mapping by optimizing and integrating mapping matters in different stages from land use to planning, construction, acceptance, and real estate registration, and realizing the sharing and mutual recognition of mapping information across relevant departments to reduce the number of mappings for enterprises. Fourth, we will issue guidance on the architect accountability system, and exempt reviews of construction drawings, planning inspection, and construction inspection for civil construction and low-risk industrial construction projects. Fifth, we will publicize information pertaining to survey and design, such as geological data needed for mapping hazard-prone areas, related conditions, and hazard prevention and control requirements of each area, thus facilitating preliminary and independent operations. Sixth, we will establish a city-wide risk classification management and control platform for project quality, and determine the frequency and content of quality and safety supervision and inspection accordingly, with only one inspection conducted for low-risk projects. Seventh, we will adopt an all-in-one acceptance process for completed projects, establish a joint-acceptance platform, and optimize the joint acceptance process. Registration and joint acceptance may be performed together for low-risk real estate projects to further shorten the time required for first-time registrations.
4. Comprehensively improve the level of municipal utility services. First, we will specify the utility access standards (water, electricity, gas, communications, etc.) for construction projects, streamline the approval process of utility access, and reduce the access costs. Second, we will reform the approval of utility access, implement parallel approval of links involved such as permissions on project planning, greening, and road-occupied construction, and explore a notification-commitment system. In addition, we will remove additional approval requirements and procedures for applications to utility access (water, electricity, gas, heat, communication and cable TV). Third, we will develop one-stop services for utility access applications, and achieve "whole-process online processing" for access applications, inquiries, payments and other business. This enables applicants to accessutility services by simply providing information, such as planning permits, property right certificate and identity cards online. Fourth, we will implement reforms on approval exemptions for non-prohibited utility access projects, further refine and publicize the scope of prohibited areas, and exempt the approval of road occupation for 5G base station power access projects outside the prohibited areas. Fifth, we will adopt a free system for eligible charging and switching facilities to access external power sources, thus reducing the cost of high-voltage power connection.
5. Accelerate the whole-process online approval of construction projects. First, we will improve the approval system for construction projects, including information sharing and business coordination with the all-in-one compliance model, joint review of construction drawings, joint examination and acceptance, supervision and inspection, and credit disclosure systems. We will also allow enterprise to submit multiple forms and materials at one time, ensure department review and approval results are pushed in real time, and provide approval documents online for printing. Second, various administrative affairs including administrative permissions, filing, evaluation and review, intermediary services, and utility access matters will be incorporated into the approval system for construction projects, while standards and expenses for such processing will be publicized.
(II) Create a more convenient market environment
Guided by the needs of market entities, we will continuously deepen the reforms on commercial and financing credit systems, and bid invitation and bidding, and create a globally leading development environment for market entities to engage in production and operation activities.
1. Further lower the threshold of market access. First, we will comprehensively sort out access issues for construction, education, medical care, and sports among other fields, clarify the name for each item, application conditions and materials, and handling processes, and disclose them to the public. We will immediately remove any unreasonable conditions set for qualifications, funds, shares, personnel, and venues of enterprises. Second, we will optimize approval of new clinics and pharmacies, and implement the filing system for practice registration of qualified clinics; and we will implement notification-commitment system for socially-funded medical institutions to export Class-B large medical equipment and for new retail enterprises that only sell Class B OTC drugs. Third, we will cancel the approval of establishment preparation of drug retail enterprises and remove unreasonable conditions for running drugstores, such as the distancing limits. Fourth, we will promote the filing system for food businesses (prepackaged food only) in China (Beijing) Pilot Free Trade Zone. Fifth, we will enable cross-regional performance information sharing through the commercial performance online approval system. For commercial performance and projects approved by cultural and tourism authorities at all levels in China, no re-approval is required for reapplication within one year of the initial approval date. In such cases, only prior filing is required.
2. Optimize the market access environment for new forms and models of business. We will conduct thorough research into reform measures to widen the market access in the digital economy sector, and tackle main issues impacting development, such as numerous conditions, high requirements and complicated procedures. First, all administrative permissions regarding new business forms and models will be included in the list of government operations and disclosed to the public; and the approval matters related to electronic sports competition and Internet medical treatment will be handled by the service desks for general affair at the municipal and district levels. Second, we will support the development of e-sports competition in Beijing, by simplifying the approval procedure, and combining the event-hosting permission with the safety permission to achieve parallel approval upon one single application. We will streamline visa application services for overseas participants in accordance with the confirmation letter of participants issued by the relevant sports authority. Third, we will optimize the development environment for Internet medical care, encourage and support medical institutions to connect with Internet platforms, and allow market entities to apply to establish both physical and internet-based medical institutions to achieve simultaneous approval and issuance of certificates. We will promote the online re-diagnosis, health consultation, and remote auxiliary diagnosis services, explore the implementation of Internet diagnosis management according to disease classification, and realize the connection of online consultation and offline diagnosis and treatment. Fourth, we will promote healthy and orderly development of online education, further clarify the time limits and standards for registering as an off-campus online education provider, and continuously update the list of off-campus online education providers registered in the city. Fifth, we will improve the efficiency and transparency of auto-driving tests, promote the mutual recognition of auto-driving closed site test results among different places, publicize the service items and charging standards of closed site tests and supervise their implementation. In addition, we plan to simplify the application and renewal procedures for auto-driving test notices, and directly extend the validity period without repeated testing for those with expired test notice but unchanged vehicle status. Sixth, we will optimize the market access system of the online car-hailing industry, introduce the city's reform plan for deepening the integrated development of cruising taxis and online hailing cars, and encourage cruising taxis to engage in online car-hailing services; we will promote data sharing among public security, transport and other departments, and realize the "whole-process online processing" certificates. Seventh, we will accelerate the approval of online game versions, expand dedicated team of professional game reviewers, and implement "filing after release" management for free and ads-free anti-epidemic and recreation game products launched during the epidemic.
3. Deepen the reform separating permit from business license. First, we will address the common issue of "access approved, operations not licensed" by comprehensively streamlining corporate business license-related matters in accordance with the national requirements for the reform separating permit from business license, and implement list management of all city-wide corporate business licenses and making the list available to the public. In addition, enterprises shall not be restricted from entering relevant industries or fields beyond the list, and general operations can be carried out independently once the business license is obtained. Second, efforts will be made to promote the "fewer permits after granting the license" initiative and simplify the approval procedure. By the end of 2021, efforts willl be made to increase the number of items requiring filing instead of approval or implementing notification and commitment to over 100, and to 150 in China (Beijing) Pilot Free Trade Zone. Third, we will set up pilot projects for the "parallel processing for permit and business license" reform for food license-related matters, to realize one application and parallel approval of the enterprise business license and administrative permit. Fourth, we will focus on solving the problems of multiple approvals and repeated approvals for market access, carry out the pilot reform of "one business, one license" in Beijing Economic-Technological Development Area, and gradually promote the reform in China (Beijing) Pilot Free Trade Zone to achieve business operations with a single license. Fifth, we will implement the reform of "one license, multiple branches". If the market entity has announced the actual business premises of its branches or registered the domiciles of the branches in the business license, all approval departments shall handle approval procedures for relevant licensing matters for its branches in accordance with the law.
4. Continuously improve the financing environment for micro, small and medium-sized enterprises. More convenient and preferential financing services will be provided that prioritize credit evaluation, guarantee, pledge, credit loan, and venture investment for micro, small and medium-sized enterprises. First, banks and guarantee institutions will be encouraged to formulate and improve the operations evaluation, loan due diligence exemption standards and processes, innovate credit service models for micro, small and medium-sized enterprises, and launch services online. Second, leverage the role of Beijing Intellectual Property Right Exchange Center to provide full-chain services such as intellectual property right registration and transaction for technology-based micro, small and medium-sized enterprises, and serve at least 5,000 technology-based micro, small and medium-sized enterprises annually. Third, financial institutions will be encouraged to strengthen cooperation with intermediary bodies regarding intellectual property rights, develop financial products, and improve the financing scale. Efforts will be made to increase the pledge loans for newly-issued intellectual property rights across the city by over 30 percent year on year. Fourth, taxation, human resources and social security departments, as well as public service enterprises, will be encouraged to establish credit evaluation standards and indicator systems, to strengthen data collection and sharing with financial institutions, guide financial institutions to strengthen innovation of credit loan products, and keep the credit loan balance for small and micro enterprises not less than 30 percent of the total. Fifth, guidelines on first-loan discounts for micro, small and medium-sized enterprises will be issued to grant interest subsidies to micro, small and medium-sized enterprises handling loan business at the municipal first loan center; and the municipal renewal loan center will provide services such as online acceptance and loan renewal with principal unpaid. Sixth, a share transfer platform for equity investment and venture capital will be built to provide short-term liquidity support and standardized exit channels for private equity holders.
5. Deepen the reform of government procurement, tendering and bidding. First, a unified government procurement platform will be established to improve the functions of online tendering and bidding, procurement review, contract signing, performance acceptance, credit evaluation and payment. Second, the one-time shortlisting of suppliers for centralized government procurement will be changed to irregular filing, to improve the participation of potential enterprises. Third, we will study and establish a unified management organization for public resource transactions to form a working system with properly-set organizational structure, separation of management and approvala, efficient services and standardized regulation. Fourth, a unified, standardized and wholly electronic public resource trading platform will be established to promote the sharing of data and information on transactions, subjects, performance, credit, and supervision, promote the supervision of various departments on the same platform, and create an open and transparent, efficient and convenient, and fair trade market environment. Fifth, we will accelerate the transformation and upgrade of the public resource tendering and bidding system, to realize end-to-end digitized processes from project registration to tendering, bidding, tender opening, bid evaluation, award of a contract, contract performance management, and payment. Sixth, we will accelerate integration of various transaction systems and public resource trading financial guarantee service platforms and provide services such as online submission of bid security and performance bonds; furthermore, we will vigorously encourage financial institutions to offer electronic guarantees in place of cash payments for enterprise-related security to ease the pressure on enterprise cash flow.
(III) Create a more open environment for foreign investment and trade
We will promote the liberalization and facilitation of investment and trade, establish a trade oversight system in line with international rules, and take effective measures to attract foreign-funded enterprises to develop in Beijing.
1. Further improve the efficiency of import and export customs clearance. First, the overall customs clearance time for import and export will be reduced to less than 30 hours and 1.1 hours, respectively. Second, we will further promote the Advance Declaration and Two-step Declaration initiatives to ensure the efficiency of Shipside Delivery of imported goods and reduce overall customs clearance time. Third, we will optimize risk control rules and reduce inspection rates for law-abiding enterprises and low-risk commodities. Customs will seek to employ enterprise-friendly inspection measures during the pandemic period by continuing to adopt a Flexible Inspection approach through the use of reservations, delays, and factory and warehouse visits and by allowing enterprises to employ Unaccompanied Inspection methods (e.g. commissioning or off-site) to ultimately reduce the time necessary to remove and inspect goods. Fourth, we will innovate facilitation measures and promote the mutual recognition of senior certification enterprises at Beijing and Tianjin Customs, and share cross-district preferential policies such as guarantee-free treatment for senior certification enterprises from the two places. Fifth, we will improve air freight transit efficiency in the city and enhance international mail sorting capacity.
2. Ease the burden on import and export enterprises. First, we will create an open and transparent port customs clearance environment, guide enterprises to actively disclose violations, and reduce customs clearance costs while reducing the comprehensive cost of port customs clearance by more than 20 percent. Second, we will publicize a list of airport operation service charges both online and offline, so that items subject to charges may be updated regularly and queried online, with no charges required off the list. Third, we will improve the fund turnover rate of foreign trade enterprises, reduce the average processing time for export tax refund business to less than 6 working days, and fully implement the paperless transaction of export tax refunds. Fourth, administrative penalties may be mitigated, reduced or exempted for enterprises actively reporting their tariff violations, if the cases are confirmed to fall within the disposal scope of active disclosure; in the event an enterprise finds through self-inspection that it has underpaid or omitted taxation after the release of goods and takes the initiative to disclose and make up the payment, the overdue fine on the late payment can be reduced or waived in accordance with the law.
3. Expand the Single Window function for international trade. The Single Window function will be expanded more quickly from port customs clearance enforcement to the full chain of logistics and trade services. First, the intermediary service function for cross-border trade will be added to the Single Window platform. Import and export enterprises will be able to conduct service evaluations of the intermediary agencies and publish the evaluations and the customs clearance time of the top 100 import declaration intermediaries, and continuously standardize and improve service levels. Second, we will use blockchain technology to improve the Beijing airport international logistics application system and the logistics inquiry system for Beijing-Tianjin-Hebei maritime customs clearance and promote whole-process/link/chain and paperless smart operation of the Capital Airport; furthermore, we will promote the linking of Customs clearance logistics data in Tianjin Port, Tangshan Port in Hebei and others, and provide enterprises with real-time "Customs Clearance + Logistics" inquiry services. Third, we will strengthen data sharing among commercial and taxation authorities, customs, the People's Bank of China, foreign exchange authorities, and so forth, encourage banks, insurance firms and other financial institutions to employ the Single Window to accurately analyze big data and provide enterprises with financial products such as tariff guarantees and tariff guarantee insurance quickly so as to ease the cash flow pressure on enterprises. Fourthly, we will open a green channel for customs declarations and set up special zones for material customs clearance services for international events such as the Beijing 2022 Olympic and Paralympic Winter Games to realize prompt inspection and release.
4. Facilitate two-way business investment. First, we will explore the establishment of a one-stop service system for foreign investment to allow enterprises to transact high-frequency matters such as corporate registration, account opening appointments, and foreign exchange registration through a single login, authentication and material submission; foreign legal representatives may empower others or conduct real-name tax certification via remote video. Second, we will further simplify the overseas investment management process, enable the "whole-process online processing" for overseas investment filing, and improve the "one-window" registration of foreign investment enterprises at the district level. Third, we will explore the establishment of pilot cross-border fund pools for both local and foreign currencies and implement two-way macro-prudential management of cross-border fund flow. Fourth, we will help qualified comprehensive foreign trade service companies to provide comprehensive foreign exchange services for cross-border e-commerce trading in goods; furthermore, we will allow exporters to settle cross-border sales payments on foreign e-commerce platforms in RMB. We will improve management measures aimed at facilitating the return and exchange of imports and exports in cross-border e-commerce and encourage and guide the city's cross-border e-commerce enterprises to actively use overseas warehouses to broaden international marketing channels.
5. Provide convenient work and living conditions for international talent. First, we will fully implement an "One-Window Acceptance, Simultaneous Issuance" for work permit and residence permit approval of foreign talents and strive for pilot implementation of work permit exemption for foreign talents with talent visas. Second, foreigners will be allowed to use their permanent residence ID cards to set up and invest in Chinese-funded companies. Third, we will improve the international version portal of the People's Government of Beijing Municipality so that foreigners can properly understand the information provided there concerning investment, work, overseas study, life and travel in Beijing.
(IV) Create a more stable employment environment
We will make greater efforts to stabilize and increase employment, remove unreasonable restrictions on employment, adapt to and promote diversified new forms of employment, promote independent corporate evaluation of skilled talents, develop flexible employment and shared employment better suited to local conditions, and further improve community-based employment.
1. Reduce and simplify employment conditions in certain industries. First, we will promote the elimination of the qualification examination for road freight-transportation drivers with the exception of those for the road transportation of dangerous goods. The drivers are able to apply for the Certificate for Road Freight-Transportation on the basis of the Training Completion Certificate for Operational Road Freight-Transportation Drivers and the corresponding driver's license. Second, we will reform the licensing examination system for veterinarians in accordance with national regulations, allowing college students of veterinary medicine to register for the examination and obtain a certificate in accordance with regulations. Third, we will promote mutual recognition of the results of workers' physical examinations in Grade II or higher level medical institutions within the city. Fourth, we will accelerate the reform of professional qualifications, and abolish the graded professional qualifications of skilled personnel in accordance with national regulations; furthermore, we will comprehensively promote the enterprise vocational skill level recognition, help enterprises independently assess skilled personnel on the basis of national occupational skills standards, and thus create a market-oriented mechanism for training and employing skilled personnel. Fifth, we will simplify employment procedures and promote the cancellation of registration certificates for fresh college graduates.
2. Promote talent flow and flexible employment. We will pursue further reforms in professional title review, sharing employment, and social insurance, encourage the free flow of talent, and support flexible employment through multiple channels. First, we will enable the "whole-process online processing" of professional title appraisal, application, review and payment, and promote electronic qualification certificates for professional titles. We will implement mutual recognition of professional title review results in Beijing, Tianjin and Hebei, and expand the scope and field of the recognition within the three places. Second, we will strengthen employment services, incorporate flexible employment and sharing job information into the scope of public employment services, support and facilitate the establishment of the labor market or gig economy, build a market-oriented service platform, and guide enterprises towards Sharing Employment, thereby allocating human resources more efficiently. We will interconnect the personnel archives of migrant personnel and accelerate the promotion of One-Point Archiving and Multi-Point Services. Third, we will promote the implementation of a unified unemployment insurance system for urban and rural areas and render identical unemployment insurance treatment for rural and urban residents. Policies concerning insurance coverage of flexibly employed persons will be introduced to accelerate the promotion of insurance coverage of all types of flexibly employed persons with a Beijing Hukou (local household registry).
(V) Create a better environment for governance
We will accelerate the building of a digital government, comprehensively promote wide-range application of blockchain-based information technologies in government affairs, and the construction of a government data sharing and credit system. We will promote a No-Meeting transaction, enable the "unified online government service" for in a wider range of activities, vigorously promote the standardization of government services, strengthen the guidance of municipal departments on the implementation of policies in each district, reinforce the development of grassroots government service windows, and strive to resolve the "last mile" problem by providing more standardized, convenient and efficient government services for market entities.
1. Focus on improving the quality of government services. First, we will seek to innovate and reform the approval method, fully implement the notification-commitment system for certifying and licensing enterprises, and clearly define items, applicable objects, working processes and regulatory measures. We will prepare a pilot implementation plan for the notification-commitment system for matters of certification. The notification-commitment system will be implemented for the remaining 51 certifications except for certification items directly related to national security, state secrets, public security, prudent supervision of the financial industry, and ecological environmental protection, as well as personal health, life and property safety, and important external matters of major risk, bearing high error correction costs and causing irreparable damage. Second, we will build a digital government affairs platform system, accelerate the construction of an information platform for digital services, digital supervision, and digital business, and coordinate all kinds of business systems providing service and supervision to enterprises. Third, we will further expand "Internet + Government Services", introduce the Action Plan for the Promotion and Application of Electronic Seals in Beijing with the use of electronic seals for paperless transactions in tax-related matters, social security registration, and housing funds among others. Fourth, we will continue to simplify and optimize the procedures for government services, handle 90 percent of city-level and 80 percent of district-level affairs through the "whole-process online processing", and promote the "whole-process online processing" for a range of inter-departmental, cross-level matters. We will continue to improve the integrated online E-Window service platform, strengthen the coordination of tax, social security, and market supervision, enable electronic delivery of cancellation notices, strive for the pilot implementation of compulsory cancellation of long-suspended yet not cancelled enterprises, and continue to simply to process of corporate cancellation. Fifth, we will continue to optimize notarization services, accelerate the "unified online government service" for high-frequency notarization services, and enable Whole-Process Online operations for application acceptance, identity authentication, material submission and payment. Sixth, we will accelerate the construction of a healthcare cloud, promote the mutual recognition of resident health files and identity recognition, electronic medical records, diagnosis and treatment information, report results and other information among different hospitals, and eliminate the repeated application of cards and unnecessary repeat examinations. Seventh, we will promote "cross-provincial processing" for government services and gradually enable "cross-provincial processing" for 140 high-frequency matters concerning enterprise production/operation and personal services. Eighth, efforts will be made to improve the standardization of government services so that the same standards will be followed at every level of government service halls and platforms. Ninth, we will continue to improve window services, fully implement first-inquiry responsibility, one-time notification, one-window acceptance, acceptance for the lack of part of the material, two-way delivery, parallel processing, and services within specified time limit, and unremittingly refine the service level of the staff . Tenth, we will improve the Government Service Evaluation System, complete the working mechanism for notification, rectification and supervision based on the evaluation, and connect the business system in the physical government service hall and the Positive/Negative Feedback system to cover all service windows and channels.
2. Continue optimizing tax payment services. We will further reduce steps, time and costs for business taxation, and promote the "whole-process online processing" of invoice processing, tax declaration and other essential steps. First, we will simplify the preferential taxation policies declaration process and transfer all taxation preference approvals to filing or approval upon declaration, thus removing the approval process. Second, we will consolidate declaration for the 5 tax types: corporate income tax (advance payment), urban land use tax, property tax, stamp tax, and land value-added tax. Also we will consolidate declaration of the value added tax, consumption tax and urban maintenance and construction tax, education surcharge, and local education surcharge. Third, the process for VAT credits and refunds will be streamlined, and online enterprise tax payment and rebate declarations can be made at one time with One Form. Fourth, VAT invoice approval will be optimized. For enterprises continuously applying for more forms and sets of invoices and meeting actual business conditions, the intelligent real-time approval of invoices will be implemented to adjust the number and form of invoices in a timely manner to more effectively meet the actual needs of enterprises. Fifth, we will further expand the scope of "contact-less" tax-related payment services, and enable the Online Processing of all tax-related government services, and the Mobile Processing of the main tax-related government services. Sixth, we will actively carry out a pilot electronic VAT invoice program and fully implement agent-assisted electronic general VAT invoicing in market places.
3. Continuously simplify real estate registration. We will expand the coverage of "whole-process online processing" and deepen the "unified online government service" for enterprise and individual real estate registration. First, we will expand the enterprise transaction inquiry service, and improve the function of the municipal real estate registration service platform, enabling entities to search government information such as business operations, tax arrears, zone-by-zone real estate regulations, and utility fees payment simply by entering the real estate location. Second, we will further improve the efficiency of "whole-process online processing" of enterprise real estate registration, and implement smart tax review on stock house trading, thus reducing the waiting time for enterprises. Third, we will promote personal real estate transaction reform aimed at simplifying the process, enable online processing of changes to the personal identity information in real estate registration and electronic tax payment certificates for stock house trading, and allow intermediary agencies to deliver personal stock house trading services through the "unified online government service". Fourth, we will promote information sharing between real estate registration and municipal utility (such as water, electricity, gas and cable television) companies for simultaneous transfer of ownership.
(VI) Create a more standardized environment for regulatory enforcement
We will strengthen top-level design of government supervision and implement hierarchical and classified supervision. We will establish a credit-based supervision system, improve the oversight conducted through random selection of both inspectors and inspection targets and the prompt release of results, continue to promote "Internet + Supervision" and cross-sector collaborative supervision, and accelerate the construction of an in-process and ex post supervision system with clearly specified rights and responsibilities, which is fair and square, open, transparent, simple and efficient.
1. Energetically promote the full coverage of oversight through random selection of both inspectors and inspection targets and the prompt release of results. First, in addition to special industries and key areas, such oversight will be carried out according to different risk levels to significantly reduce the number of inspections. Second, in response to the principle of "supervision to be conducted by the authority who approves or administrates", we will continue to expand the scope of such oversight and aim to place at least 90 percent of corporate items under inspection with randomly selected inspectors and targets by all departments. Third, we will further expand regulatory coverage of such oversight mode across multiple departments, draw a second list of cross-departmental spot inspection items, and include all inspection items subject to frequent inspection, significantly interfering enterprises, and suited for consolidation into the scope of cross-departmental random inspection.
2. Strengthen credit supervision through the process. First, we will improve the whole-process credit regulatory mechanism involving advance credit verification and credit commitment, in-process credit evaluation, and ex post credit publicity, credit reward and punishment, and credit restoration. Second, public credit assessment standards will be announced after using the municipal public credit information service platform to comprehensively study and assess the credit status of market entities, form comprehensive public credit assessment results, and share them in a timely manner with the relevant departments in various industries. Third, we will take the lead in introducing credit assessment measures to education, science and technology, housing and urban-rural construction, transportation, water affairs, commerce, culture and tourism, and promote the establishment of a hierarchical, classified supervision system based on the results of comprehensive public and industrial credit assessment. Fourth, we will actively promote the implementation of identification standards and processes for identifying breaches of contract and faith, keep complete records on the fulfillment of commitments, and incorporate them into the municipal public credit information platform; furthermore, preferential treatment shall be shown to market entities with good fulfillment records, with heavier penalties meted out to failures of fulfilling their commitments.
3. Provide innovative, inclusive, and prudent supervision. With an eye to the nature and characteristics of new business forms and models, we will explore the development of Sandbox Supervision and Trigger Supervision among others, give full play to the role of platform supervision and industrial self-discipline, and implement flexible and smart supervision in certain areas. First, we will continue to promote "Internet + Supervision", strengthen data collection in key areas, and intensify risk tracking and early warning. Second, we will study and create detailed rules for implementing inclusive and prudent supervision of new industries and new business patterns within the city, and explore the development of Sandbox Supervision for fintech, live online broadcasting and short video marketing. Third, we will accelerate the creation of an online medical service supervision platform to conduct comprehensive and whole-process supervision of online diagnosis and treatment services, and collect and analyze violations in a timely manner through systematic early warning, thereby ensuring medical safety. Fourth, we will strengthen cooperation between administrative departments for education and the relevant functional departments, professional institutions, and industry associations and enterprises, and establish a normalized monitoring/early warning/notification mechanism for educational mobile applications. Fifth, we will undertake to employ administrative guidance through means such as interviews to first remind and warn those engaged in illegal operations offering dishonest online tourism services or misusing technical means to set unfair trading conditions, and then stop them completely and order them to make amends for their actions within a set time limit. Sixth, we will set up credit records for online ride-hailing platform companies, incorporate them into the national credit information sharing platform, and publish information such as the administrative licenses and administrative penalties. Seventh, we will step up to refine the regulatory standards system in various fields, encourage the industry to develop higher self-discipline standards, implement the enterprise standards fore-runner system in more fields, and promote the improvement of product competitiveness and the upgrading and transformation of the industry.
4. Further standardize regulatory enforcement. First, we will seek to improve the list of approval power matters, clarify the supervisory responsibilities of the relevant industry authorities, reform and standardize the in-process and ex post supervision, and promote streamlined approval to remove barriers through effective in-process and ex post supervision; furthermore, we will sort out the relationship between the relevant industry authorities and integrated law enforcement agencies, and establish a supervisory system with clear duties and responsibilities and efficient operation. Second, we will study and develop full subject and variety regulatory standards and processes across the entire chain of fields and sectors that directly relate to national and public security and the people's safety and health, such as vaccines, medications, special equipment and dangerous chemicals, as well as standardize law enforcement rules and behaviors, and further improve regulatory efficacy. Third, we will comprehensively sort out and create a list of enterprise-related inspection matters within the city, establish a unified comprehensive information platform for enterprise-related inspection within the city, implement the total quantity control inspection with randomly selected inspectors and targets across various departments, and effectively enhance the normative and systematic enterprise-related inspection. Fourth, off-site supervision such as remote supervision, mobile supervision, and early warning prevention and control will be implemented, and matters that can be properly supervised through off-site supervision will not be included in the on-site inspection. Fifth, we will regulate the exercise of discretionary power in administrative punishment and implement graded and hierarchical discretion in strict accordance with the harmfulness of the violations and the prevailing circumstances so as to resolve problems related to unfair enforcement and inappropriate discretion. Sixth, a robust law-enforcement error-tolerant correction mechanism will be established. After administrative guidance measures, such as critical education and guidance interviews, have been implemented, administrative penalties will be exempted for minor violations that are corrected in a timely manner without resulting in serious consequences.
(VII) Create a fairer environment to safeguard the rule of law
We will establish a guarantee system based on the rule of law, improve the quality and effectiveness of trials, increase the protection of intellectual property rights, accelerate improvements to the arbitration system, and protect the legitimate rights and interests of various market entities according to law.
1. Strengthen judicial protection for civil and commercial cases. Efforts will be made to improve judicial efficiency by focusing on key components such as mediation, evidence collection, identification, and trial implementation. First, we will further deepen the pilot project to reform the diversion of complex and simple civil litigation by striving to classify 80 percent of cases as summary procedures and small claims. Second, a multi-purpose dispute resolution center for foreign-related business will be established to offer "One-Stop" notarization, mediation and arbitration services for foreign-related business cases. Third, we will continue to employ the "Cloud-based Court" established during the epidemic and encourage online court trials across the municipality. Fourth, we will help the court to expand the scope of application for the independent second instance system for civil and commercial cases. For cases with clear facts and legal relations, the second instance can be heard by one judge, which further improves trial efficiency. Fifth, we will help the court to further standardize enforcement, strictly control the timing of each stage of enforcement, strictly prohibit excessive asset seizures, and minimize the impact of enforcement on normal business operations to more effectively safeguard the legitimate rights and interests of entrepreneurs.
2. Establish and improve the enterprise bankruptcy system. First, we will help the court to establish an early consultation mechanism for stakeholder bankruptcy cases and study and establish an underpayment guarantee mechanism for employees of insolvent enterprises. Second, we will take advantage of potential of the government-court linkage mechanism, establish bankruptcy rules for substantive mergers between affiliated enterprises, simplify bankruptcy procedures, and reduce the disposal cost of bankrupt enterprises. Third, regulations for how to deal with real estate disposal shortcomings in bankrupt enterprises will be issued to further clarify relevant rules, standards and procedures and to improve the efficiency of property disposal. Fourth, the courts will be encouraged to set up a bankruptcy administrator assessment committee, issue assessment specifications, and establish a regular assessment mechanism. Bankruptcy service windows will be set up in the municipal and district government service halls to simplify the work of bankruptcy administrators. Fifth, we will help the court to improve the training of judges hearing bankruptcy cases and of bankruptcy administrators and ameliorate their professional capabilities to better deal with bankruptcy cases.
3. Strengthen the protection of intellectual property rights (IPR). First, we will promote research and the subsequent formulation of Beijing IPR Protection and Promotion Regulations, and improve various IPR protection mechanisms such as the empowerment of job-related scientific and technological achievements and overseas IPR protection. Second, a "blacklist" system of untrustworthy IPR entities will be established to publicize enterprises with repeated and intentional infringements and to restrict serious untrustworthy entities in government procurement and tendering and bidding. Third, we will increase the responsibility of market entities, intensify the search for and punishment of illegal and criminal acts such as the manufacture and sale of counterfeit and inferior products and infringement upon intellectual property rights, and accelerate the introduction of punitive compensation and large penalty systems for fields directly related to the health and well-being of the people; furthermore, we will establish rules for typed adjudication compensation in IPR cases and reasonably determine IPR loss criteria with reference to third-party assessments. Fourth, we will expand the range of services provided by the Intellectual Property Right Protection Center, increase the acceptance of applications for trademarks and geographical indication applications, administrative adjudication on patent infringement, and remote arbitration and litigation services, and improve the efficiency of IPR application and dispute resolution.
4. Make commercial arbitration more professional and international. First, we will extend the opening up in the arbitration field and allow well-known overseas arbitration institutions to register and establish business branches in certain regions to provide arbitration services for disputes in international commerce, investment and other fields. Second, we will study and introduce measures aimed at helping overseas arbitration institutions to more easily arrange housing for staff, facilitate their entry-exit and residence and stay, and open foreign exchange accounts. Third, we will vigorously promote "Internet + Arbitration", improve the arbitration case management system, expand the functions of online hearings and services, and improve arbitration efficiency.
III. Organizational support
(I) Strengthen organizational leadership. We will improve the promotion mechanism in place for optimizing the business environment at the municipal and district levels and solidify the city's national business environment assessment organization mechanism, thus establishing a work pattern collectively coordinated and led by competent municipal leaders and jointly promoted by the leading department and the responsible departments. All departments will strengthen coordination and cooperation in combination with their respective responsibilities and promote reform in relevant fields in an integrated manner. Efforts will be made to buildspecial teams for business environment, allocate strong working forces, and implement various reform tasks.
(II) Improve the long-term mechanism. We will establish and improve the policy assessment system, focus on the policy effect assessment, and establish a long-term advance and ex post assessment mechanism for major policies. We will strengthen the assessment of business environment and conduct irregular assessment of government service halls at all levels through the use of various methods such as "Four Nos and Two Directs" (no advance notice, no prior contact, no report hearing, no escorting, visiting grassroots units and the sites directly), open and unannounced investigations, and entrusting third-party professional institutions, after which the assessment results will be incorporated into performance management We will establish an integrated assessment index system involving the national assessment, the World Bank assessment and district-level assessment and carry out business environment assessments in different areas. We will summarize and promote the experiences and practices gained in optimizing business environment in a timely manner to ensure actual results of the reform.
(III) Strengthen communication between businesses and the government. We will take advantage of the expert advisory committees, social supervisors and government service testers, establish normalized information communication channels, and further enhance the scientific nature of the reform and its relevance and effectiveness. We will employ the 12345 enterprise service hotline to respond to complaints immediately upon reception and coordinate the resolution of market entity problems within a set time limit to improve the quality of enterprise services. We will carry out "head official to go through processes" activities, and all districts and departments will further identify problems in the administrative procedures in an effort to continuously improve services. We will employ the "Service Package" for enterprises and offer proactive, enthusiastic, and forward-looking services, in a bid to foster an honest government-business relationship.
(IV) Take advantage of the rule of law as a guide and guarantee. Regulations on Optimizing the Business Environment will be implemented to consolidate what reforms have already achieved. Taking the building of a national pilot city for business environment innovation as an opportunity, we will actively communicate and report to relevant national authorities to promote the adjustment and implementation of relevant laws and regulations and authorize the municipality to carry out pilot trials, and gradually develop institutional rules and norms based on effective and long-term practices, so as to maintain a fair and competitive environment by the rule of law.
(V) Carefully implement preferential business policies. All districts and departments will organize and publish a list of favorable policies and accurately promote policies in accordance with specific needs of enterprises. Furthermore, each district will issue announcements concerning the relevant persons in charge and the corresponding contact information when publishing the favorable policies. We will actively implement "Online Fulfillment Without Application" of enterprise preferential policies that favorably benefit eligible enterprises through government information sharing and big data application. For preferential policies that do require enterprises to apply, such as the special-fund subsidies from the government and key project support, reasonable application conditions will be established and publicized, application materials and working processes will be simplified, and industrial associations, chambers of commerce and other institutions shall be invited to evaluate the preferential policies and operation guidelines so as to accelerate the realization of the "One-Time Application, Whole-Process Online Processing, and Efficient Fulfillment".
(VI) Conduct publicity and training extensively. All districts and departments will proactively publish and interpret the reform policies, summarize and publicize reform practices and experiences in a timely manner, and make it as simple as possible for enterprises and the public to make inquiries and understand the policies. Government service halls will be further strengthened, and the "Small Windows, Whole-Hearted Services" activity will be implemented widely so as to continuously improve the service awareness and business skills of front-line staff.
