Regulations on Strengthening Construction of Service Windows in the Field of Real Estate Registration

In order to optimize the business environment of Beijing Municipality, improve the service level in the field of real estate registration and make it easier for businesses and masses to handle their affairs, while drawing on the experience of Chaoyang District in carrying out pilot work of optimizing "One Window for All Matters", the regulations on the matters concerning strengthening the construction of service windows are hereby issued as below:
I. Categories of windows at government affairs service hall
All service halls for real estate registration in individual districts generally have three categories of service windows: Comprehensive Window, Acceptance Window and Payment and Collection Window. In particular, a comprehensive window is one set up according to the criteria of "get one thing well done" where two or more departments work jointly to handle business for businesses and masses, encompassing the procedures involved in house ownership transfer such as signing contract online, tax evaluation and payment, property ownership registration, registration fee payment and issuing certificates; an acceptance window is one where each department handle the aforementioned business individually. In addition to house ownership transfer, it also include other registration affairs to be handled by real estate registration department, as well as registration information inquiry. A Payment and Collection Window is one where the parties concerned can pay the fees and collect certificates in addition to those handled in the Comprehensive Window.
II. Service pattern and business categories at Comprehensive Windows
In accordance with the service pattern of "one window accepting, internal circulation, in-time conclusion of matters and issuing certificates at the same window, and taking into account the service needs of applicants, the services provided at a Comprehensive Window can fall into the following categories:
1)Business of house stock purchase between individuals who have signed contract online and passed the tax pre-examination (It takes a total of 45 minutes). For such business, the personnel at the window will review the application materials (verify the consistency between uploaded materials in the pre-examination system of taxation and the paper materials submitted on the ground); collect tax payable from both buyers and sellers; and transfer the materials to those responsible for registration examination. After the examination is passed, issue tax payment certificate and invoices, collect registration fee and issue real property ownership certificate etc;
2)Transfer registration business for newly built personal house purchase (purchase contract has been signed), stock house purchase between individuals (contract has been signed online), house donation between individuals and others which have not gone through tax pre-examination (It takes a total of 60 minutes). For such business, the personnel at the window receive all required application materials and hand them over to tax and registration personnel. After the examination is passed, collect taxes and fees, issue tax payment certificate and invoices, collect registration fees, issue real property ownership certificate and so on;
3)Business of house stock purchase between individuals for which contract signing online and tax pre-examination have not been done (It takes a total of 90 minutes). For such business, the personnel at the window receive all required application materials, go through signing contract online in time and hand the materials over to tax and registration personnel for examination. After the examination is passed, collect taxes and fees, issue tax payment certificate and invoices, collect registration fees, issue real property ownership certificate and so on;
4)Business of transfer registration involving businesses (a three-party agreement between taxation, treasury and bank has already existed and therefore money transfer can be conducted immediately through the system) (It takes a total of 90 minutes). For such business, the personnel at the window receive all required application materials, hand them over to tax and registration personnel for examination. After the examination is passed, collect taxes and fees, issue tax payment certificate and invoices, collect registration fees, issue real property ownership certificate and so on;
5)Business of transfer registration involving businesses (a three-party agreement between taxation authority, treasury and a bank is not concluded and therefore tax has to be paid through a bank) (It takes a total of 180 minutes). For such business, the personnel at the window receive all required application materials, hand them over to tax and registration personnel for examination. After the examination is passed, issue a Bank Inquiry Tax Payment Certificate. Once the tax is paid, the Comprehensive Window will finish all steps including the issuance of tax payment certificate and invoices.
III. Required application materials at the Comprehensive Window and prescribed time limit
The required application materials for different business at the Comprehensive Window shall be in accordance with the Regulations on Promoting the Streamlined Application Materials in Real Estate Registration in Beijing Municipality issued by Approval Reform Office of Beijing Municipality (hereinafter referred to as the "Regulations") and other relevant provisions. All kinds of business at the Comprehensive Window must be concluded on the same day. If a company selects to pay tax at bank, follow the day when the bank slip is submitted.
IV. Streamlining of house purchase qualification
Where house purchase qualification has been pre-examined and the corresponding paper materials need to be checked next step, all service windows shall streamline the required materials as per the following provisions:
1)Where an applicant has signed contract online at the Acceptance Window, no submission of paper materials for qualification examination will be required for the transfer registration;
2)Where a house-buying family has submitted materials for qualification examination and passed the online joint examination, no submission of materials containing family information will be required. Before the expansion of joint data examination is achieved, where qualification examination is passed in the category of married family and minor children information is input, no submission of materials containing family information will be required.
3)Where a house stock was purchased in the category of "family of holding valid Beijing Work & Residence Permit and the qualification examination was passed before May 1, 2012, no submission of such permit will be required;
4)House transaction department will feed the field and results information concerning house purchase qualification materials for examination to the real estate registration department and allow the personnel at the window to gain access to the transaction system inquiry. The real estate registration department will add house purchase promise in the record of questions and will not require an application form of family buying house, house purchase promise and result of house purchase qualification examination.
V. Other requirements
All districts need to intensify the allocation of administrative resources such as personnel and work space, accelerate the integration of personnel at the Comprehensive Windows, enhance business training and risk control, so as to provide more convenience for businesses and individuals while ensuring the business handling quality. Meanwhile, all relevant departments should actively promote the joint handling of real estate registration, house transaction and tax collection, and guide the state-by-stage business needs of the parties to the Comprehensive Windows in a reasonable manner. For such groups as the disabled, the pregnant and servicemen, upgrade and expand the service function of Comprehensive Windows into green channels.
