Article 1 This Measures are hereby formulated in accordance with the Regulations of Beijing Municipality on the Protection and Promotion of Patents and in light of the actual situation of the Huairou District to encourage the invention and creation of enterprises, institutions and individuals, enhance the District's capacity for independent innovation, and promote scientific and technological progress and economic development.
Article 2 The Huairou District People's Government shall establish the "Special Fund of the Huairou District for Subsidizing Patents", which shall be included in the district-level financial budget and jointly managed by the Huairou District Intellectual Property Office and the Huairou District Finance Bureau. The amount of the Special Fund is properly adjusted every year based on the authorization of patents.
Article 3 For the purpose of this Measures, subsidies are mainly used for subsidizing authorized patentees and commercialization projects.
Article 4 Utilization and management of the subsidies shall be in accordance with relevant national laws, administrative regulations and relevant rules, following the principles of honest application, impartial acceptance, scientific evaluation, merit-based support, fairness and transparency.
Article 5 The Huairou District Intellectual Property Office, as the department in charge of patent subsidizing, is mainly responsible for:
(I) Determining the principles and purposes for using the subsidies;
(II) Preparing budgets and final accounts of annual support funds;
(III) Organizing reviews and evaluations of the declared subsidies; and
(IV) Reviewing subsidies declarations of commercialization projects.
Article 6 Conditions for applying for patent subsidies:
(I) The applicant shall be a unit registered in the Huairou District or an individual whose permanent residence is registered in the district. Where there is more than one patentee for the patent involved, the applicant must be the primary patentee.
(II) The patents for which subsidies are applied shall be valid ones for invention, utility model or design (excluding national defense patents and confidentiality patents), with clear patent ownership and stable legal status.
(III) The units or individuals that have obtained the patent authorization in the previous year and meet the conditions for subsidy shall be granted a one-time subsidy.
(IV) The projects for which subsidies for patent commercialization are applied shall be the ones that have obtained the authorized invention patents over the past 5 years, with clear patent ownership and no infringement dispute occurred, which have been successfully commercialized and achieved great economic benefits. The commercialization models include independent commercialization, licensing and transfer of patents.
(V) Priority shall be given to subsidizing commercialization projects in key industries of Beijing Municipality and the Huairou District, and those of patent demonstration units and pilot units in Beijing.
Article 7 A subsidy shall be granted according to the following criteria if the conditions stipulated herein are met after reviewing:
(I) Where the patent applicant obtained domestic patent authorization in the previous year, the subsidy shall be CNY 5,000 for every invention patent, CNY 1,000 for every utility model patent, and CNY 500 for every design patent.
(II) Where the applicant obtained foreign invention patent authorization in the previous year, a one-time subsidy of CNY 5,000/patent/country shall be granted, but the subsidy for each invention patent shall not exceed CNY 25,000.
(III) The subsidy granted to the unit applicants for patent authorization under this article shall not exceed CNY 200,000 each year, and up to CNY 50,000 each year for individual applicants.
(IV) Priority shall be given to subsidizing the projects successfully commercialized from invention patents. The amount of subsidy for each project shall not exceed CNY 200,000, and no more than 3 projects shall be subsidized each year.
Article 8 The Huairou District Intellectual Property Office shall formulate relevant implementing rules in accordance with this Measures, effectively accepting, approving, releasing and reviewing subsidies.
Article 9 The applications for subsidizing authorized patents and commercialization projects shall be made by the applicants in time collectively and in accordance with this Measures and the implementing rules, and will be rejected if made beyond the specified time limit. The applicants shall submit the corresponding application forms and supporting materials as specified, and fill in relevant information strictly according to the facts.
Article 10 Where it defrauds when applying for a subsidy, the applicant shall return the allocated funds within the specified time limit. Where an applicant violates laws, relevant authorities shall handle the case in accordance with relevant laws and regulations.
Article 11 The Huairou District Intellectual Property Office is responsible for interpreting this Measures.
Article 12 This Measures shall come into force as of September 15, 2015.
