Chapter I General Provisions
Article 1 To regulate the enrollment, cultivation, and management of international students in kindergartens, primary and middle schools in Beijing Municipality, the Measures are hereby formulated according to the Education Law of the People's Republic of China, Compulsory Education Law of the People's Republic of China, Exit and Entry Administration Law of the People's Republic of China, and Administrative Measures for the Enrollment and Cultivation of International Students by Schools. The measures aim to better serve the pursuit of building the capital into the national political center, cultural center, center for international exchanges, and center for scientific and technological innovation center, and improve the capital's education readiness to serve international students.
Article 2 "Schools" as used herein refer to kindergartens, primary and middle schools whose establishment has been officially approved by administrative authorities of education in the administrative region of Beijing Municipality.
"International students" as used herein refer to students of school age who are not Chinese citizens according to the Nationality Law of the People's Republic of China and are educated in schools in Beijing Municipality.
Article 3 Schools that enroll and cultivate international students shall abide by the laws and regulations of China, safeguard national sovereignty, security, and public interest of the State. The schools shall be managed to ensure the quality of education according to the law and relevant standards.
Article 4 Beijing Municipal Education Commission shall guide, coordinate and supervise the work concerning international students in Beijing Municipality. The Foreign Affairs Office of the People's Government of Beijing Municipality shall take charge of coordinating foreign affairs of international students and handle matters related to international students as authorized by the Ministry of Foreign Affairs of the People's Republic of China. Beijing Municipal Public Security Bureau shall manage the stay and residence of international students and handle illegal activities that involve these students according to the law.
Article 5 The administrative education departments of the districts shall, within their respective administrative regions, be responsible for planning, guiding, and supervising the work concerning international student. The Foreign Affairs Offices of the People's Government of all the districts shall take charge of managing and coordinating foreign affairs related to international students. Public Security Sub-Bureaus of the districts shall manage the stay and residence of international students and handle illegal activities that involve international students according to the law.
Article 6 Schools that enroll international students shall establish and improve the systems for enrolling, cultivating, managing and serving international students, and shall take on greater responsibility for the enrollment and cultivation of international students.
Chapter II Enrollment Administration
Article 7 Schools that enroll international students shall meet the corresponding education and teaching conditions, be capable of cultivating international students, and enroll them in accordance with the relevant provisions of the State and Beijing Municipality. Entrusting or authorizing agencies or individuals for enrollment is forbidden.
Article 8 Schools that enroll international students shall undergo the filing formalities as prescribed by the district administrative education departments. Secondary specialized schools shall undergo the filing formalities at the Beijing Municipal Education Commission.
Article 9 For parents who are not permanent residents in Beijing during an international student's studies, they shall produce an official entrust that assigns a permanent foreign or Chinese resident to serve as the student's guardian and submit a notarized or certified birth certificate of the student and the guardian's letter of attorney. The entrusted shall also conduct a notarization of entrust acceptance in Beijing Municipality.
Article 10 Schools shall sign agreements with foreign dispatch units before accepting international students who come in groups for short-term studies. Foreign dispatch units planning to send groups of students for short-term studies at primary and secondary schools that accept international students shall handle the legal formalities required for organizing the exit and entry of minors according to local laws. These dispatch units shall have designated personnel to guide the group and serve as the guardian of international students during their studies in China.
Article 11 The international students shall have ordinary passports before applying for admission. Changing procedures are required if the international students hold other types of passports. Schools shall not accept the application of those who fail to handle their passports as prescribed.
Article 12 Items and standards of charging fees for the international students shall follow relevant regulations of Beijing Municipality. The schools shall develop and publish the information of fees and refund rules, including fee details, conditions, standards and procedures, as well as refund provisions for withdrawal or change of schools. Both charges and refunds shall be calculated in renminbi.
Chapter III Education and Teaching
Article 13 Schools shall include teaching plans for international students into its overall teaching plans. Teachers suitable for teaching international students shall be selected and assigned. Effective system shall be established and improved to ensure education and teaching quality.
Article 14 Schools shall follow the student status management provisions of Beijing Municipality in managing international students to register and update their information in time, and issue academic or other certificates for them in accordance with the regulations of the State and Beijing Municipality. In the case of international students withdrawing from school or being dismissed, schools shall promptly report to the local exit and entry administration of the public security departments and undergo the filing formalities in accordance with the relevant regulations of Beijing Municipality.
Article 15 Standard spoken and written Chinese of the People's Republic of China is the general language utilized in teaching international students in schools. For international students who are unable to use standard spoken and written Chinese language in their studies, the guardian shall adopt practical measures to improve their Chinese proficiency.
Article 16 Schools shall provide entrance education, involving such topics as Chinese laws and regulations, school disciplines, conditions of China and the schools, excellent traditional Chinese culture and customs, and safety tips to help international students adapt to the study and living environment as quickly as possible.
Article 17 Schools shall faithfully record the academic and daily performance of the international students. For international students who are frequently absent or not at school for extended periods of time, schools shall handle the situation in accordance with relevant provisions of Beijing Municipality and rules of the schools.
Article 18 Schools shall pay close attention to the mental health of international students and strengthen the education on mental health and with corresponding support.
Article 19 Schools shall organize international students to participate in social practice activities that are planned in the teaching plan.
Chapter IV On-campus Management
Article 20 Schools shall appoint personnel to take charge of the work concerning international students and designate divisions for international students' enrollment, teaching, daily management, and services.
Article 21 Schools shall establish and improve the provisions of international students' enrollment, visa processing, student status, accommodation, and safety management. It shall develop emergency plans, designate personnel for emergencies, and define working processes for handling emergencies.
Article 22 Schools with appropriate conditions shall provide necessary living facilities to international students, and establish, improve and publish management provisions on the use of such facilities. Schools shall help international students living on campus to register and then report the information to the public security authorities within 24 hours after the student's check-in. For international students living off-campus, schools shall verify whether the registration information is consistent with the actual address and ensure that they live with their parents or guardians. Schools shall also remind their parents or guardians to register the students' accommodation at the public security authorities within 24 hours after the students' move-in.
Article 23 Schools shall respect the ethnic customs of international students. Religious activities, such as preaching and gatherings, are not allowed on campus.
Article 24 In the event of major accidents or emergencies concerning international students, schools shall promptly report the matters to relevant municipal and district departments.
Chapter V Visa and Residence Certificate Management
Article 25 Foreign nationals from outside China who intend to visit and study in Beijing Municipality shall apply for an X1 or X2 visa before the study period at an embassy or consulate of China, or foreign agencies entrusted by the Ministry of Foreign Affairs of the People's Republic of China, in the country or region of the applicant's nationality. For long-term studies, international students shall submit relevant materials, including certificates filed by administrative authorities of education and an Admission Notice issued by the school among other documents (students above the age of 18 shall submit a Physical Examination Record for Foreigners), when applying for an X1 visa. For short-term studies, international students shall submit relevant materials, including certificates filed by administrative authorities of education and an Admission Notice issued by the school among other documents, when applying for an X2 visa.
Article 26 Foreign nationals holding other types of visas, stay permits, or non-X residence permits who intend to stay for long-term studies and meet the visa issuance conditions shall apply for a study-related stay permit or a change of such permit with the exit and entry administration of the public security departments in Beijing Municipality, by providing certificates filed by administrative authorities of education and an Admission Notice issued by the school among other documents.
Article 27 International students who needs to obtain a residence permit after entry shall apply for the residence permit for X visa holders at the exit and entry administration of the public security departments in Beijing Municipality within 30 days after their entry and submit relevant materials including the Admission Notice issued by the school and a letter of admission certificate indicating the study period.
To apply for visa extension, international students shall submit the required materials to the exit and entry administration of the public security departments in Beijing Municipality seven days before the expiration of the period of stay.
To apply for residence permit extension, international students shall submit required materials to the exit and entry administration of the public security departments in Beijing Municipality 30 days before the expiration of the period of stay.
Chapter VI Rights and Obligations of International Students
Article 28 Schools shall provide general information, education and teaching conditions, and international student management and services system of the school to international students, and facilitate their access to such information.
Article 29 Schools shall sign a Letter of Notification with international students' parent(s) or guardian(s) to inform them that students shall comply with Chinese laws and regulations, follow the school rules, and participate in all education and teaching activities. Terms related to charges and refunds shall also be included in the Notification.
Article 30 International students shall comply with Chinese laws and regulations, respect traditional Chinese customs, and follow the school rules. Students shall attend courses and complete learning tasks according to the program of courses and teaching plans, and take examinations or assessments in accordance with the regulations.
Article 31 International students shall finish the confirmation procedures for the Physical Examination Record for Foreigners at the health and quarantine departments of China, or fulfill the physical examination upon admission, in accordance with the regulations of the Chinese administrative health authority. As identified during the physical examination, any case of severe mental disorders, infectious tuberculosis, or other infectious diseases listed in the Exit and Entry Administration Law of the People's Republic of China that may endanger the public health shall be handled by the public security departments according to the law.
Article 32 Schools shall implement an insurance system for all international students. International students shall apply for insurance according to regulations of the State and rules of the schools. International students who fail to purchase the prescribed insurance as required shall be insured within the specified period. Students who fail to purchase the prescribed insurance within the time limit shall not be admitted; students who have arrived on the campus shall be dismissed or refused to register.
Chapter VII Supervision and Administration
Article 33 For schools committing violations against Article 44 of the Administrative Measures for the Enrollment and Cultivation of International Students by Schools, the administrative authorities of education will require the schools to correct or rectify its behavior, hold the schools responsible in accordance with the Education Law of the People's Republic of China, and restrict the schools from enrolling international students.
Article 34 International students committing violations against the Exit and Entry Administration Law of the People's Republic of China, Public Security Administration Punishments Law of the People's Republic of China, Regulation of the People's Republic of China on the Administration of the Entry and Exit of Foreign Nationals and Rules for the Implementation of the Provisions on the Administration of Religious Activities of Aliens within the Territory of the People's Republic of China shall be treated by the public security authority and other competent departments in accordance with the law. International students who violate school disciplines shall be dealt with by the schools in accordance with the relevant rules.
Chapter VIII Supplementary Provisions
Article 35 The term "short-term studies" used herein refers to a study period of no more than 180 days, while the term "long-term studies" used herein refers to a study period of more than 180 days.
Article 36 The Measures shall apply to schools providing non-academic education whose establishment has been officially approved by the administrative authorities of education in the administrative region of Beijing Municipality.
The enrollment, cultivation, and administration of schools for the children of foreign nationals shall be carried out in accordance with other relevant regulations of Beijing Municipality.
Article 37 The Measures shall be implemented as of the date of printing and issuing. Several Provisions on the Administration of the Acceptance of Foreign Students by Primary and Middle Schools in Beijing Municipality, issued by Beijing Municipal Education Commission, Foreign Affairs Office of the People's Government of Beijing Municipality and Beijing Municipal Public Security Bureau on January 6, 2000, are repealed simultaneously.
Article 38 The Measures shall be interpreted by Beijing Municipal Education Commission.
