With regard to acquitted and non-convicted persons: 

Except for the effective adjudication documents of The People's Court to confirm the guilty, all other circumstances are innocent. If the relevant persons are suspected of committing a crime, but The People's Court has not yet made an effective judgment or ruling, or The People's Procuratorate has made a decision not to prosecute, or the case-handling department revokes the case, withdraws the prosecution, or terminates the investigation, they are persons with no criminal record.

*Reminder: Foreign nationals are required to have resided in China for a total of 180 days or more (inclusive).

(1) In the case of inquiring in person, submit the Inquiry Application Form (see Annex 1.docx) and your valid passport or permanent residence permit.

(2) If you entrust another person to inquire on your behalf, in addition to submitting the Inquiry Application Form (see Annex 1.docx) and your valid passport or per permanent residence permit, you should also submit the power of attorney, and the original identification document of the trustee.

(1) Inquiries in person must be processed by the exit-entry administration department of the county-level public security sub-bureau at the place of residence;

(2) If someone is entrusted to apply for inquiry on your behalf (the trustee shall have full capacity for civil conduct), it shall be processed by the exit-entry administration department of the public security sub-bureau at the place of residence of the trustor.

(1) Accepted applications that can be processed onsite shall be processed onsite, and if not, an Acceptance Receipt (see Annex 1.docx) shall be issued to the applicant and be processed within three working days.

(2) With applications that are circumstantially complex, investigation and verification shall be carried out with reference to the review process after being approved by the person in charge of the sub-bureau of the Beijing Public Security Bureau. The time it takes for investigation and verification shall not be included in the processing period. If the investigation and verification require the cooperation of the parties concerned, the parties concerned shall cooperate.

Any one of the following circumstances is considered a complex situation:

*The identity of the applicant needs further verification;

*Cooperation of other entities is required in investigation and verification;

*The parties involved refuse to cooperate with the investigation and verification;

*Other circumstances that require investigation and verification. 

For individual inquiries, if no criminal records are found related to the applicant, processing organizations shall issue a Certificate of No Criminal Conviction (see Annex 3.docx); if not, a Notification of Refusal to Issue a Certificate of No Criminal Conviction shall be issued to the applicant (see Annex 4.docx). With applicants that have a criminal record of a crime committed under the age of 18 with a limited term of imprisonment of no more than five years, the processing organizations shall issue a Certificate of No Criminal Conviction (see Annex 3.docx).

(1) Parties invovled that appeal against the inquiry results can apply to the initial processing organization for review and submit the Application Form for Review (see Annex 2.docx). When the processing organization conducts the review, the objecting applicant shall cooperate with the public security authority to carry out the review.

(2) Within 15 working days of acceptance for processing, the initial processing organization shall reply to the objecting applicant, in writing, in the name of the public security sub-bureau with the results of the review. If the situation is complex and it is impossible to investigate thoroughly and reply within the prescribed time limit, the review may be appropriately extended with the approval of the person in charge of the public security sub-bureau, and the objecting applicant shall be informed, but the extension period shall not exceed 30 working days at most.

(3) Upon reviewing, if the Certificate of No Criminal Conviction (see Annex 3.docx) or the Notification of Refusal to Issue a Certificate of No Criminal Conviction (see Annex 4.docx) is indeed incorrect, the initial issuing organization or its superior public security authority shall revoke the issuance on time and reissue relevant documents.

(4) If the objecting applicant believes that the court judgment on which the processing organization relied on to issue the Certificate of No Criminal Conviction is wrong and meets the statutory appeal conditions, the processing organization may inform the objecting applicant to appeal to the relevant court and procuratorate in accordance with the legal procedures. 

(1) If an individual applies for more than three inquiries (excluding three inquiries) in a natural year, the individual shall submit relevant materials to prove that the Certificate of No Criminal Conviction will be utilized for reasonable purposes. With other special circumstances, please call the 12367 hotline of the National Immigration Administration for consultation.

(2) The Certificate of No Criminal Conviction (see Annex 3.docx) or the Notification of Refusal to Issue a Certificate of No Criminal Conviction (see Annex 4.docx) shall be signed for by the applicant or trustee.

(3) The inquiry of criminal records shall be based on the Criminal Information Inquiry Platform of the Ministry of Public Security of the People's Republic of China and other relevant information inquiry platforms. The inquiry results only reflect information entered and existing on the platform during the inquiry. 

(1) No individual shall apply for an inquiry of criminal records, forge or alter the Certificate of No Criminal Conviction (see Annex 3.docx) by means of fabricating facts, concealing the truth, providing false materials, fraudulently using identities, etc. If an individual violates the relevant laws and regulations in carrying out an inquiry of criminal records and causes serious consequences, the individual shall be investigated for personal responsibility according to law; and if a crime is constituted, criminal responsibility shall be investigated according to law. 

(2) The inquiry shall be carried out in strict accordance with the prescribed procedures, and the relevant criminal information obtained through inquiry shall be kept confidential and shall not be disseminated or used for other purposes. Acts of violating relevant laws and regulations shall be investigated for corresponding responsibilities according to law; and acts that constitute crimes shall be investigated for criminal responsibilities according to law.
