For any couple where at least one partner is a foreigner, a resident of Hong Kong SAR, Macao SAR or the Taiwan region, or overseas Chinese, if the couple wants to divorce, the two partners should go to the responsible marriage registration authority in person to register the divorce (except for the marriages between two foreigners). The steps are as follows.
Materials Needed
1. Identity documents (a valid passport or any other international travel document for a foreigner; a valid passport for an overseas Chinese; a valid Mainland Travel Permit and a valid ID card for a resident of Hong Kong SAR, Macao SAR or the Taiwan region);
2. Both parties should hold three copies of their divorce agreement which clarifies the intention of both parties to divorce voluntarily and the consensuses on child support, property division, debt management, and other issues (both parties shall sign at the marriage registration authority in person);
3. A marriage certificate issued by a marriage registration authority in the Chinese mainland or by a Chinese embassy or consulate;
4.Each party shall provide two recently-taken 2-inch (3cm*4cm) color photos (half-body and bareheaded; the two photos must be the same).

Note:
Cooling-off period for divorce
According to Article 1077 of the Civil Code of the People's Republic of China, within 30 days from the date on which the responsible marriage registration authority receives the divorce registration application, if either of the parties does not want to divorce, the divorce registration application may be withdrawn from the marriage registration authority. Within 30 days after the expiration of the cooling-off period stipulated in the preceding paragraph, both parties shall go to the marriage registration authority in person to apply for a divorce certificate. If they fail to apply, it shall be deemed that the divorce registration application has been finally withdrawn.
Fees:
No fee is charged for obtaining divorce certificates.
Requirements
1. Both parties should be present at the responsible marriage registration authority in person;
2. Both parties are individuals with full capacity for civil conduct (no history of mental illness, mental retardation, etc.);
3. The agreements on child support, property division, debt management, and other issues have been reached by both parties;
4. The marriage of both parties was registered with a marriage registration authority in the Chinese mainland or a Chinese embassy or consulate.
Notes
1. The marriage registration authority in charge will not accept the application in any of the following situations:
The parties have not registered their marriage with any of the marriage registration authorities in the Chinese mainland, or Chinese embassies or consulates;
2. The parties are both foreigners and request to register divorce with a marriage registration authority in the Chinese mainland;
3. After registering their marriage in the Chinese mainland, both parties have obtained foreign nationalities;
4. After registering their marriage in the Chinese mainland, any of the parties has adopted a different name or/and a new identity document of which the information is different from that recorded during the marriage registration, and the partner concerned cannot provide written proof of the reason(s) for the change(s);
5. One of the two parties cannot express his/her real intentions in Chinese, and there is no third-party individual or organization to translate his/her real intentions into Chinese.
In any of the aforementioned situations, the parties can go to a People's Court for divorce.
