For the purpose of fully implementing the decisions of the CPC Central Committee and the State Council on improving the business environment, implementing the Opinions of the State Council for on Conducting Innovative Pilot Programs of Business Environment (Guo Fa [2021] No. 24), the Implementation Plan of Beijing Municipality for Innovative Pilot Programs of Business Environment is hereby formulated to further strengthen the business environment reform, continuously create an international business environment that is market-oriented and based on the rule of law, cultivate and stimulate the vitality of market entities, and promote the high-quality development of the capital.
I. General Requirements
(I) Guidelines. Upholding the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era and thoroughly implementing the visions outlined at the 19th CPC National Congress and plenary sessions of the 19th CPC Central Committee, based on the strategic positioning of Beijing as the capital, we shall seize the major opportunity of building national pilot cities for business environment innovation. To follow high standards to align with the world-class business environment, and take high-quality development as the theme and institutional innovation as the core, we shall comprehensively push forward with reforms to streamline administration and delegate power, improve regulation and upgrade services, ensure better alignment between an efficient market and a well-functioning government, and create a world-class business environment. In doing so, we shall be able to enhance enterprises' and people's sense of fulfillment, happiness and security, further stimulate market vitality and social creativity, and ultimately provide strong support for accelerating the integration into the new development pattern, promoting the modernization of China's system and capacity for governance, and achieving high-quality development of the capital.
(II) Major Objectives. We shall focus on institutional and mechanism obstacles that hinder individuals and enterprises from handling affairs and starting up businesses, strengthen reform and innovation and explore a list of replicable and scalable "Beijing experiences", so as to maintain the leading role of Beijing in China's business environment reform. We will, through three to five years' efforts in the innovation pilot, strive to greatly improve the government's governance performance and the capability of gathering and allocating various domestic and foreign resources, establish Beijing among the global leaders in international business environment competitiveness and create a world-class business environment that is in line with the strategic positioning of the capital.
II. Main Tasks
(I) Further removing unreasonable restrictions that impede the allocation of market resources.
First, we shall advance the reform of "one certificate for multiple locations". To make it convenient for enterprises to expand their business, regarding frequent operation permits for supermarkets (convenience stores) and medical equipment wholesalers, etc, enterprises in fields not directly related to public security and people's safety and health do not need to reapply for such permit for their branches conducting the same business after having made corresponding commitments.
Second, we shall further eliminate the hidden barriers in bidding and government procurement, improve the municipal public resources trading and integrated government procurement platforms and promote the usage of standard bidding and procurement documents. Industry regulators shall conduct online supervision of related bidding and government procurement activities based on the municipal public resources trading supervision platform and government procurement management system, thus guaranteeing fair competition of various market entities.
Third, we shall promote digital certificate compatibility and reciprocal recognition in the bidding field, formulate and implement uniform data and technological interface specifications. We shawill enable the use of the same CA certificates by enterprises to participate in bidding activities in Beijing, and propel the reciprocal recognition of CA certificates among the six innovation pilot cities.
Fourth, we shall push ahead with the reciprocal recognition of seven electronic certificates including the qualification certificate for road transport practitioners, road transport operation permit, and road transport license between Beijing and the other five innovation pilot cities, Tianjin and Hebei, and conduct online certificate verification, so as to facilitate the cross-regional operations of transport enterprises.
Fifth, we shall optimize the cross-regional flow and quarantine application procedures for common low-risk plants and plant products, and exempt low-risk plant and plant product suppliers from quarantine application by specifying the categories of and quarantine requirements for low-risk plants and plant products in the municipality and publicizing related information on the national plant quarantine information management system and forestry plant quarantine management information system.
(II) Establishing a more open, transparent, standardized, and efficient market access and exit mechanism for market entities.
First, we will pilot the reform to facilitate the registration of corporate domiciles (business premises) in Haidian District, develop a standard corporate domicile (business premise) database and domicile negative list, and achieve automatic online standard domicile (business premise) information matching and generation after registration and automatic information verification to check whether the domicile (business premise) is in line with the specifications of the negative list. Applicants with a verified standard domicile (business premise) do not need to submit the evidentiary materials for the ownership of the domicile (business premise) and can apply for enterprise establishment and alteration of business registration immediately after promising the authenticity and legality of the domicile (business premise).
Second, we shall advance the reform to integrate multiple reports into one by simplifying the content, reducing the frequency of corporate annual reports, strengthening information sharing, and enabling enterprises to only fill the same information once, so as to realize the integration of annual reports regarding market supervision, social security, taxation, customs affairs, and other aspects.
Third, we shall set up the market access performance evaluation system supported by an index system and an information platform to implement the market access negative list, improve the approval efficiency, and eliminate hidden barriers. Regular supervision and evaluation shall be conducted over the implementation of market access-related policies, and unreasonable market access conditions shall be canceled in a timely manner.
Fourth, the law firm name approval procedures shall be optimized. The law firm name database of the national lawyer management information system shall be connected for law firm name inquiry. The municipal judicial authority shall make the preliminary approval decision for the law firm name application, and register related information at the Ministry of Justice, thereby shortening the time for law firm name approval.
Fifth, we shall explore and establish a system for removal of market entities. The market entities, being listed for abnormal operations or marked as abnormal operators for two years, and failing to pay taxes over the past two years, can be removed by the commercial registration authority. Removed market entities shall complete liquidation and cancel the registration according to the law and shall not engage in activities unrelated to the liquidation and the registration cancellation.
Sixth, procedures for disposal of bankrupt enterprise land and house property disposal procedures shall be improved. As for projects for which the completion acceptance can still be applied, related procedures shall be handled according to related laws and regulations. Where the project completion acceptance cannot be finished because the debtors' related materials are incomplete or a third party (such as a design, investigation, or supervision unit) does not cooperate in the acceptance, the debtor can apply for the real estate registration for the project after the entrusted qualified project quality assessment institution verify the qualification of the project, so as to speed up the monetization of the debtor's real estate and land resources.
Seventh, we shall perfect the credit repair mechanism for enterprises going through reorganization. Enterprises with a reorganization plan approved by the court shall publicize the approved reorganization plan on the official website of Credit China (Beijing), the National Enterprise Credit Information Publicity System (Beijing), and the Basic Financial Credit Information Database, making the progress of their reorganization public in a timely manner. The corporate credit repair method shall be formulated. For enterprises with a reorganization plan approved by the court, related credit limits and disciplinary measures shall be adjusted according to laws and regulations. Eligible bankrupt enterprises are allowed to conduct activities including bidding, financing, and issuance of letters of guarantee during the implementation of the reorganization plan to help them resume normal operations.
(III) Enhancing the facilitation of investment and construction. We shall deepen the reform of the construction project examination and approval system on the premise of effectively preventing illegal construction and ensuring project quality and safety.
First, the reform of the land use list system for non-governmental investment projects shall be propelled. Rules for regional seismic safety, water impact, and traffic assessments shall be formulated. The results of seismic safety, water impact, and traffic assessments and the results of geologic hazards, underlying mineral resources, and archaeological site investigations in a region shall be included in the land bidding, auction, and listing documents. Construction projects in such region after the land is put into use are in principle not required to undergo the above-mentioned assessments to avoid repetitive work.
Second, the reform to integrate multiple surveys shall be pushed forward. The integration of project completion acceptance, completion surveying in the real estate registration stage, and real estate surveying shall be continued. The land surveying and demarcating and cadastral surveying shall be further combined, so as to realize single entrustment and result sharing at the same stage.
Third, the architect accountability system shall be perfected. Efforts shall be made to propel the orderly development of individual architecture firms. The architect accountability system shall mainly be promoted in small and medium-sized construction projects in commercial cultural service, education, medical, wellness, and low-risk industries. Whole-process engineering consultant service offerings will be encouraged to keep in step with the international engineering construction model. The approval procedures for the architect accountability system projects shall be simplified. The requirements notification and compliance commitment mechanism shall be implemented for the design drawing technical review at the project planning permit stage, and only the procedural legality will be reviewed.
Fourth, the requirements notification and compliance commitment mechanism for construction permits will be piloted in Beijing Economic-Technological Development Area. For buildings and municipal infrastructure projects that need a construction permit, applicants will be allowed to apply for the permit through the requirements notification and compliance commitment mechanism, which further shortens the approval time.
Fifth, separate examination and acceptance of unit projects shall be put into trial implementation. For industrial plants and warehouses of several unit projects under the same construction project planning permission, joint examination and acceptance of unit projects completed for use shall be carried out separately on the premise that the projects meet the overall quality and safety requirements and conditions for safe use. The accepted projects will be allowed to move on to the next process or the production and operation to improve the efficiency of project operation.
Sixth, we shall promote the integration of the environmental impact assessment (EIA) of industrial parks and projects. We shall classify and manage construction projects in the parks according to environmental risks. Projects with low environmental risks shall be exempt from EIAs. Moreover, we shall implement the requirements notification and compliance commitment mechanism for projects with medium environmental risks and optimize the EIA criteria for those with high environmental risks to avoid repetitive assessment.
Seventh, we shall simplify the approval procedures for municipal facility access projects and enlarge the scope of approval exemptions for unprohibited municipal access projects. Also, we shall implement the parallel approval system for other projects to further increase the access efficiency of municipal facilities.
(IV) Better supporting the innovative development of market entities.
First, we shall accelerate the cultivation of the data market and promote the formulation of preferential policies for the digital economy, establishing a data trading system covering data trading rules, multi-level authentication rules for data trading subjects, data classification and protection rules, and cross-border data trading rules as soon as possible. We shall explore data ownership confirmation and build a new regulatory system in an open environment in terms of data circulation and data security. Focusing on areas such as finance, credit, and medical treatment, we shall promote the trade of high-value core data in Beijing's data trading platforms and constantly expand the scale of data trading.
Second, the open public data platform shall be upgraded and changed. We shall make the annual municipal public data opening list and plan, releasing public data on business registration, health, meteorology, finance, and transportation in a safe and orderly manner according to the development needs of enterprises, thus energizing the development of new industries and new business types. We shall guide scientific research institutions, social organizations, and state-owned enterprises and institutions that provide public services for the masses to release valuable data in accordance with laws and regulations, promoting people's livelihood services, social governance, and industrial development.
Third, we shall deepen the reform of the right to use, dispose of, and derive income from scientific and technological achievements, implement a distribution policy oriented toward increasing the value of knowledge, strengthen management and services throughout the process of commercialization of research findings, and encourage more colleges and universities as well as research institutions to carry out pilot programs to confer the rights to use scientific and technological achievements, with the aim of stimulating research staff's enthusiasm for innovation and promoting the transfer and commercialization of research findings.
Fourth, we shall further improve the market-based pricing and transaction mechanism for intellectual property rights, establishing a joint release mechanism for cross-regional intellectual property exchange information at Beijing Intellectual Property Exchange, which provides information listing, transaction matching, asset appraisal, and other services for intellectual property exchanges, thus helping technology enterprises in quick pledge financing.
Fifth, we shall perfect the intellectual property pledge financing risk sharing mechanism and the mechanism of disposition of pledged property, improve intellectual property pledge financing policies, and build a capital pool for intellectual property pledge financing risk compensation. We shall also explore the models of guarantee institutions and other institutions to quickly dispose of pledged property through the conversion of pledge rights to stock rights, cross-licensing from licensees, auction, and other methods. Moreover, we shall issue securitized products of intellectual property, expand financing channels for technology enterprises, and reduce their financing costs.
Sixth, we shall optimize the management of information change of technology business incubators and maker spaces. National-level technology business incubators and maker spaces officially filed can apply for changes in name, area, business location, and other information in real time, while such changes may be directly approved by municipal departments of science and technology, without the need any more to report to national science and technology authorities.
Seventh, we shall promote the development of new business patterns of automatic food production vending machines. Ensuring food safety and abiding by relevant laws and regulations, we shall regulate the automatic production and sales business by issuing food business permit with the pilot on automatic production and sales of coffee and orange juice.
(V) Continuously improving the facilitation of cross-border trade.
First, we shall deepen the reform of the integration of customs clearance and supervision in Beijing, Tianjin, and Hebei, promote the quick customs clearance model of "One Port Clearance" through land and sea ports in the three regions, and expand the pilot scope of "supervised packing and production, direct delivery upon arrival at port", so as to facilitate the quick customs clearance of exporters in Beijing.
Second, we shall improve the inspection notification and other functions of the "single window", further strengthen the informatization of Beijing Capital International Airport, realize the pre-notification of cargo inspection to cargo owners and terminals, and quickly connect customs clearance with logistics, thus improving the speed of import and export cargo inspection.
Third, we shall boost the integrated development of multimodal transportation and improve the freight information system platforms of railway, highway, and air transportation, enabling us to break through the information barrier, explore electronic waybill sharing under multimodal transportation, make transport capacity information accessible, and realize real-time cargo tracking.
Fourth, we shall accelerate the customs clearance of products exempted from China Compulsory Certification (CCC) and make a white list of enterprises that import products exempted from CCC. Beijing Municipality will no longer accept or verify CCC exemption certificate applications. Instead, enterprises on the white list will be allowed to make commitments, fill in the application form independently, and obtain the certificate automatically, further improving the efficiency of product clearance.
Fifth, we shall start pilot projects for the free cross-border flow of research supplies and make a positive list of cross-border research supplies. Enterprises and research entities shall make commitments in advance and declare supplies on the list, including equipment, samples, reagents, and consumables. Customs shall facilitate customs clearance and simplify processes such as customs declarations, quarantine approval, and management of regulatory documents, so as to improve the efficiency of customs clearance of research materials.
(VI) Optimizing management of foreign investment and international talent service.
First, we shall improve the official web portal of the People's Government of Beijing Municipality (www.beijing.gov.cn), optimize the column of "Investment in Beijing", focus on improving guidelines on market access for foreign investment, human resources services, and scientific and technological innovation, thus realizing the one-stop approval services for more foreign-related matters covering investing, work, and daily life. We shall also further interpret the policies of the "Two Zones", providing one-stop service for policy interpretation.
Second, we shall enhance the ability to resolve international commercial disputes, vigorously introduce professional organizations, and establish a joint model for litigation, mediation, and arbitration of foreign-related commercial cases.
Third, we shall encourage mediation organizations and arbitration institutions to introduce foreign mediators and arbitrators, and improve relevant work standards for the introduction of foreign personnel. To facilitate international commercial arbitration, the notice of trial issued by domestic arbitration institutions is allowed to be taken as visa certification for overseas market entities to enter Beijing to participate in the arbitration. No invitation letters are required.
(VII) Maintaining the order for fair competition.
First, we shall advance the electronic reform of bidding in all fields, processes and factors, offer the online processing of government service items concerning contract signing and modification in fields including housing construction, municipal administration, transportation, water supply, landscape architecture, and survey and design, connect the electronic bidding system and the treasury payment system, and promote online payment and inquiry for government-funded construction projects, to realize the whole online handling process of bidding, bid opening, bid evaluation, bid winning, contract fulfillment, and payment for higher bidding efficiency.
Second, we shall establish a system for releasing bidding invitation plans in advance. For projects of enterprises dominated or controlled by state-owned funds to call for tenders as required by the law, the bidding invitation plans shall be published at least 30 days ahead of the bidding invitation announcement, so as to improve the transparency of bidding activities.
Third, we shall simplify the formal review of the qualifications of suppliers for government procurement by issuing policies to simplify the review process, where suppliers are no longer required to provide proof materials covering their financial conditions, tax payments, and social security funds, thus reducing their transaction costs.
Fourth, we shall strengthen and improve anti-monopoly and anti-unfair competition law enforcement and build a unified platform economy supervision system for Beijing that reinforces monitoring, analysis, and collaborative supervision of platform enterprises, and guide platform enterprises to achieve standardized, healthy, and sustainable development.
Fifth, we shall standardize the collection of fees and fines, establish and improve the list-based management system for enterprise-related inspection and penalty matters, regularly review the changes in the list according to adjustments in laws and regulations, and continue to supervise and inspect activities such as illegal collection of fees, fines, and apportioned charges of enterprises, so as to relieve the burden on enterprises.
(VIII) Enhancing supervision and further developing new supervision methods.
First, we shall explore ways to establish a comprehensive supervision mechanism. We shall establish a comprehensive regulatory mechanism in the fields including single-use commercial prepaid cards, agricultural products, and refined oil products, clarify the responsibilities of regulatory departments in each link, formulate unified industry regulatory standards, exchange information on quality and safety monitoring and law enforcement, strengthen coordinated supervision, joint law enforcement, and case transfer, and intensify quality and safety supervision and law enforcement. Moreover, we shall implement the Administrative Regulations of Beijing Municipality for Single-use Prepaid Cards to regulate the prepayment market.
Second, we shall establish the whole-process supervision mechanism. In key fields such as fire control, food and drugs, environmental protection, water and soil conservation, and health care, we shall specify key matters, procedures, and targets for regulation, and formulate regulatory standards and credit supervision standards for industries and employees, establishing a whole-chain and whole-process supervision system to improve the effectiveness of supervision.
Third, we shall perfect the hierarchical risk management model, apply the market supervision department's classified indicator scoring model for credit risk supervision to score enterprises in Beijing, integrate scoring results with social credit rating results for market entities, incorporate the results into the supervision platform featuring random selection of targets and inspectors and public disclosure of inspection results, and conduct differentiated supervision.
Fourth, we shall implement inclusive and prudent supervision, develop proper advanced management policies for new industries and business patterns, including intelligent connected vehicles, artificial intelligence, and hydrogen energy, specify the bottom line for quality and safety and leave adequate development space for new industries and business patterns.
Fifth, we shall implement the punitive damage and internal informant systems, lawfully develop punitive damage measures for food, drug, vaccine, environmental protection, safety production, and other sectors, perfect the internal informant management measures and enhance the law-breaking cost of enterprises to protect consumers' legal rights.
(IX) Protecting the legal rights of various market entities according to laws.
First, we shall issue government dishonesty compensation and accountability measures and compensate enterprises for legal interest losses caused by policy changes, planning adjustments, and contract breaches in the debt financing, government procurement, bidding, business and investment invitation, and other sectors. The government commitment legality review system shall be established and implemented for administrative regulatory documents, agreements, and contracts of governments and related departments at all levels. Meanwhile, the record of government dishonesty and default shall be established, the government dishonesty complaint and reporting mechanism shall be perfected, and dishonesty problems shall be handled through supervision, notification, interviews, and other measures to protect enterprises' legal rights.
Second, we shall strengthen joint intellectual property protection. We shall create unimpeded exchange channels for information on national and municipal trademark infringement judgment, patent infringement judgment, and trademark patent laws. We shall intensify the treatment of malicious trademark registration and abnormal patent application and cooperate with China National Intellectual Property Administration on patent tour and remote reviews to enhance intellectual property protection and dispute resolution efficiency.
Third, we shall reinforce overseas intellectual property dispute assistance services, improve the foreign-related intellectual property dispute response, notification, and judgment mechanism, and issue overseas intellectual property risk prevention guidelines for cross-border R&D cooperation and talent introduction. We shall perfect the municipal overseas intellectual property government service information base, with a focus on the information about B&R participating countries and RCEP members, and promote the sharing of overseas right protection service resources in Beijing, Tianjin, and Hebei to enhance enterprises' ability to cope with overseas intellectual property disputes.
Fourth, we shall promote the electronic management of judicial documents, improve the electronic document filing system, and optimize and specify the electronic document filing procedure. Application scenarios of electronic records shall be expanded constantly. Under the premise of lawfully protecting the privacy of relevant parities, online verification channels for effective documents of real estate registration agencies and other government functional departments shall be set up to help parties handle government service matters according to effective court judgment documents.
(X) Optimizing recurrent enterprise-related services.
First, we shall conduct unified querying for registration information of security interests over movable properties and rights, perfect the electronic database for motor vehicle security and registration with the guarantor name as the index, and incorporate the registration information of motor vehicles, ships, and intellectual properties into the unified registration and public notification system for movable properties financing of the Credit Reference Center, People's Bank of China to give enterprises access to real-time collateral status and enable them to conveniently conduct financing.
Second, we shall simplify the non-notarial succession procedure of real estate and optimize the real estate succession (bequeathing) registration procedure in Beijing. If the successor first in order provides written commitments with authentic and effective application materials, the successor second in order shall not need to submit materials on-site, and the successor first in order can handle the procedure after independent inspection, so as to improve the efficiency of real estate succession registration.
Third, we shall carry out "internet plus real estate registration" among all types of business, implement agent-assisted electronic general VAT invoicing in the transaction of existing personal houses, and promote online tax payment to reduce the payment frequency and improve the service experience.
Fourth, we shall share real estate registration information and push the online verification of nationwide household registrations, death certificates, legal documents, and lawyer identity information to reduce the required materials and energy-consuming visits of applicants and further increase the convenience of real estate registration.
Fifth, we shall establish visual retrieval and query mechanisms for real estate registration information and enable any people to query the natural condition, right restrictions, and cadastre of real estate on electronic maps after authentication to effectively prevent real estate transaction disputes.
Sixth, we shall promote enterprises to use the business license in handling all types of matters. We shall accelerate the application of electronic licenses and data sharing among government departments, and explore the policy that enterprises can handle high-frequency government service matters regarding operating permits, tax payment, social security, medical treatment, and civil administration with business licenses only to simplify application materials and avoid repetitive submission.
Seventh, we shall expand the application scope of electronic licenses and signatures, first use them in the clearance of goods, bank loans, project applications, bid invitations, and government procurement and connect the online municipal government service hall and other systems with the public service signature system to enable the online affixing of enterprises' electronic seals on electronic forms and reduce the energy-consuming visits of enterprises and people.
Eighth, we shall optimize the application for enterprise-favorable policies. We shall rely on the Jingtong app to gather national, municipal, and district-level policies, explore policy implementation and intelligent verification, fully leverage the big data technology to match enterprise profiles with applicable policies for targeted policy promotion and preferential access to policy benefits without having to file an application.
III. Organizational Support
(I) Strengthening organizational leadership. We shall establish the coordination and promotion mechanism for the business environment innovation pilot work under which responsible officials from the municipal government lead respective sectors, with participation of all districts and departments concerned in the whole process. We shall set up 16 special working groups for the fields of business system reforms, construction project approval, government services, law enforcement supervision, judicial protection, financing and credit, public facility access, real estate registration, etc. The municipal business environment optimization task force shall reinforce the overall coordination, insist on monthly scheduling, and solve key problems to ensure the smooth progress of the pilot work. Leading units of the special working groups shall carry forward reform tasks in corresponding sectors and report major problems in a timely manner to responsible officials from the municipal government for coordination. Leading units of specific tasks shall conscientiously perform their duties, properly arrange the reform schedule, and organize responsible units to promote pilot tasks according to high standards and at high quality, so as to accumulate nationally-leading reform experience. Responsible units shall actively cooperate with each other and report to relevant national departments in a timely manner to enhance interactions at different levels and collaboration among departments.
(II) Intensifying supplementary reforms. Focusing on rule and institutional innovation, leading units of specific tasks shall organize responsible units to develop work plans and propose use cases for every reform task and evaluate completed tasks one by one to summarize replicable and scalable reform experience. Departments concerned may issue work plans and supporting policies for implementing reform tasks in corresponding sectors based on real conditions and adjust policies in specific areas concerning state-authorized reform items to establish the regulatory and policy systems that fit pilot requirements.
(III) Reinforcing innovative applications. All departments concerned shall accelerate the connection and data sharing with relevant national systems to achieve high connectivity, proper application, and substantial results. The departments shall deepen the application of government affairs data, electronic licenses, electronic seals, and electronic records, actively create innovative application scenarios, promote the connectivity, recognition, and mutual-use across different departments, in various sectors and at different levels, and give full play to data sharing to vigorously streamline procedures, reduce required materials and shorten the time for the convenience of the people.
(IV) Strictly implementing policies. Districts with good foundations shall be selected as demonstration zones to promote various reform tasks to create overall effects, and concentrate on successful cases, publicity effects and useful experience. All departments concerned shall strengthen the guidance and coordination of demonstration zones and first conduct reforms in key districts to drive the improvement of the overall business environment. They shall make a better effort in publicity and training, interpret reform policies and measures in business environment innovation pilot programs, summarize good experience and practices of pilot programs in a timely manner, and raise the awareness of enterprises and the public. Besides, they shall reinforce the training of front-line staff and forge ahead in the "last mile" of policy implementation to maximize the benefits from reform pilot programs. The implementation of innovation pilot tasks shall be evaluated and the implementation of reforms shall be tracked regularly to let enterprises and the public enjoy reform dividends.
(V) Insisting on steady implementation. All departments concerned shall balance development and safety, properly manage the timing, pace and steps with risks basically under control, and carry out interim and ex-post supervision.
