Commercial Arbitration

Beijing, a city with favorable judicial environment and a mature arbitration system, provides a convenient environment for cross-border and trans-regional business entities to resolve disputes equally and fairly. Beijing Arbitration Commission/Beijing International Arbitration Center (hereby known as BAC) provides first-class dispute resolution services for businesses in different countries and regions.

Improvement in Business Environment

Enhance the ability to resolve international commercial disputes, and actively introduce professional organizations to establish a joint litigation, mediation and arbitration processing model for foreign-related commercial cases.

Mediation organizations and arbitration institutions are also encouraged to introduce foreign mediators and arbitrators as well as to put in place sound introduction procedures and standards for them. Currently, about 22 percent of the arbitrators working in BAC are foreign employees.

To facilitate the international commercial arbitration activities in Beijing, notice of hearing issued by domestic arbitration authorities are allowed to be used as visa documents for entities of foreign markets to enter Beijing for arbitration. No other invitation letter is required.

Arbitration Case Filings

1. Scope of acceptance

Arbitration institutions accept disputes over economic contracts and disputes over other property rights and interests between citizens, legal persons and other organizations. Arbitration institutions shall not accept administrative disputes falling within the jurisdiction of relevant administrative organs, labor relations disputes, disputes over agricultural benefit contracts within collective agricultural economic organizations, as well as disputes involving personal relations such as marriage, adoption, guardianship, support and inheritance.

2. Prerequisites

Where the parties in dispute wish to settle the dispute through arbitration, they shall enter into an arbitration agreement. An arbitration agreement shall include the arbitration clauses provided in the contract and any other written form of agreement concluded before or after the disputes providing for submission to arbitration.

BAC revised its arbitration rules in 2022. Under the revised rules, the presiding arbitrator of each case can be jointly nominated by the arbitrators appointed. The rules also stipulate that the tribunal may choose to hold virtual hearings.
