How should employees defend their rights when they find their wages are being paid in arrears? Beijing Municipal Human Resources and Social Security Bureau will share 4 ways everyone can safeguard their rights and interests should this occur.

First, call 12333 to make a report and receive information on policies. If employees find they are being paid in arrears, they should first consult relevant policies, and Beijing 12333 hotline provides public 24/7 policy explanation and consultation services. At the same time, Beijing 12333 hotline will accept complaints and reports on wage arrears and forward them to the municipal labor security supervision department for handling.

Second, employees can file a complaint and report directly to the labor security supervision department where they are employed. The address and telephone number for filing complaints and reports of all labor security supervision institutions can be found on the official website of Beijing Municipal Human Resources and Social Security Bureau. In addition, the labor security supervision department of Beijing has also rolled out a QR code to safeguard the rights of employees. So long as they are being paid in arrears while working in Beijing, employees from all over China can complain and report online. Employees have two options. The first is to get on the official website of Beijing Municipal Human Resources and Social Security Bureau and scan the labor security rights protection QR code found on the homepage. The second is to follow the official WeChat account of Beijing Municipal Human Resources and Social Security Bureau (Beijing Renshe, ID: beijing_12333), and click on "services (微服务) - handling services (办理服务) - labor security reports and complaints (劳动保障举报投诉)".

Third, employees may apply to the labor dispute mediation and arbitration institution for mediation and arbitration. In case of any dispute over wage arrears and the amount with an employer, employees can apply to the labor dispute mediation institution for mediation in the street, township or industrial park where the employer is located. Alternatively, they may also refer to the industry labor dispute mediation institution according to the law. If mediation fails or the employer is unwilling to mediate, employees can apply for arbitration to the arbitration institution where the labor contract is performed or where the employer is registered according to the law. Employees who do not accept the results of the arbitration, may file a lawsuit according to the law.

Fourth, employees in the Beijing-Tianjin-Hebei region can file a complaint and report payment in arrears at any location within this region. For employees working and also having their household registrations in Beijing, Tianjin or Hebei, they may at their discretion choose to file a complaint and report at any location within the Beijing-Tianjin-Hebei region that has a labor security supervision institution at or above the county level at their places of work or household registrations. For example, an employee from Hebei Province who has been working and living in Beijing for many years, may file a complaint and report on wage arrears in Beijing, which is easier for safeguarding the labor rights.
