Cancelling Work Permits in China: Instructions for Foreign Applicants

The employer needs to apply for the cancellation of work permits for foreigners working in China, according to the following guidelines:

► One original (electronic/paper) copy of the Application Form for Cancellation of Foreigner’s Work Permit 

After logging in to http://fwp.safea.gov.cn/ to fill out the online form, the applicant must print it out, sign it, affix the employer's official seal or the official seal of the authorizing departments, and upload it into the system.

► One original (electronic/paper copy) certification of the terminated employment relationship, terminated contract or other certifying materials demonstrating the reasons for cancellation 

The termination certificate must be signed by both parties. In the case that the applicant leaves their position on their own and the employers cannot contact them, the employer shall submit a cancellation explanation as a supplement.

► One original (electronic/card copy) of the Foreigner’s Work Permit

Includes Foreign Expert Certificates and Foreigner Employment Certificates within the current validity period.

1.All original paper materials and Chinese translations must be uploaded (in original color) to the management service system for foreigners working in China.

Please note: All non-Chinese certification materials submitted must be provided with Chinese translations and stamped with the official seal of the employer (except the passport or international travel documents). 

 The authorizing   or decision-making institution may request the employer to submit a corrected version if there is a serious discrepancy between the Chinese translation and the original.

2.After an online pre-review is passed, please make an appointment in the system, then bring your appointment voucher and all original application materials to the proper site for handling. High-Level Foreign Talents (Class A) do not need to make an appointment and can bring all materials directly on-site for handling.

Pre-review period: Three workdays (One working day for High-Level Foreign Talents (Class A))

Handling period: Three workdays

No Charge.

1. Foreigner’s Work Permits will automatically be cancelled if not extended upon expiry of the validity period; if the permit is withdrawn and cancelled and the permit certificate is revoked in accordance with the law, the decision-making institution must cancel them. If the applicant dies, loses his/her civil capacity, terminates their contract early or terminates the employment relationship, the employer shall apply for cancellation to the decision-making institution within ten working days of the event. If the employer is terminated, the applicant may apply to the decision-making institution to cancel the work permit.

2.If the applicant leaves their position without permission and fails to get in touch for more than 15 days, the employer shall publicize a notice of the foreign employee’s unauthorized leave  in a newspaper above municipal level for ten days. If no contact has  has been established by the end of this publicity period, and no objection has been raised by the foreigner themself, the employer may submit application for the cancellation of the work permit in the management service system for foreigners working in China, upload the Cancellation Application Form (stamped with official seal, exempted from the signature of the foreigner), the resignation Certificate (stamped with official seal, exempted from the signature of the foreigner), the original copy of newspaper (where the post and the newspaper heading show the time of publication and the newspaper level), description (including basic information for the foreign personnel, information regarding the unauthorized departure, attest the content is true, whether any subsequent problems have occurred, the unit shall bear all responsibilities, then affix the official seal and the signature of the legal representative) and other materials, and cancel the work certificate. Note: the company name, passport, work permit number and other basic information must be indicated in the newspaper announcement.

3. If the employer is terminated in accordance with the law, the form Applying for Cancelling the Foreigner’s Work Permit need not be affixed with the employer's official seal, and the employer must provide relevant materials (such as the  employer cancellation certificate issued by the industry and commerce department) demonstrating that the employer is terminated in accordance with the law and thus cannot apply for cancelling the permit, the Applicant's letter describing permit cancellation and Work Permit for Foreigners.

4. If the Foreigner's Work Permit has been cancelled, the decision-making institution shall issue a certificate of cancellation upon application. If the system automatically cancels the expired work permit, the decision-making agency will not issue the certificate of cancellation.

5. If there are salary commitments involved in the work permit, then when cancelling the Foreigner Work Permit, a salary commitment letter, the following two items should be submitted: a personal income tax record consistent with the commitment (originally: Tax Payment Certificate); a screen capture document (with official seal) for a detailed inquiry of the client's personal withholding statement of the natural person e-tax bureau. If unable to submit these, then this dishonest behavior shall be recorded.
