Regarding Innocent Persons and Those Without a Criminal Record:
Except where a legally effective judgment or ruling by a People's Court confirms guilt, all other circumstances shall be regarded as not guilty. If an individual is suspected of committing a crime, but the People's Court has not yet issued a legally effective judgment or ruling, or the People's Procuratorate has issued a decision not to prosecute, or the case-handling authority has withdrawn the case, revoked the prosecution, or terminated the investigation, such individuals shall be considered as having no criminal record.
*Kind Reminder: Applicable to foreign nationals who have resided in China for a cumulative period of 180 days or more.
(1) In the case of inquiring in person, submit the "Inquiry Application Form" (see Annex 1.docx) and your valid passport or permanent residence permit.
(2) If you entrust another person to inquire on your behalf, in addition to submitting the "Inquiry Application Form" (see Annex 1.docx) and your valid passport or per permanent residence permit, you should also submit the power of attorney, and the original identification document of the trustee.

(1) If the receiving unit can handle the application on the spot, it shall do so immediately; if it cannot do so on the spot, it shall issue an "Application Acceptance Receipt" (see Annex 1.docx) to the applicant and complete the application within three working days.
(2) If the situation is complicated, with the approval of the head of the public security bureau, an investigation and verification process may be conducted in accordance with the review procedure. The time for investigation and verification shall not be included in the processing period. If the investigation and verification process requires cooperation from the parties, the parties shall cooperate.
The following situations are considered complicated:
* The identity of the applicant needs to be further verified;
* Other units need to cooperate in the investigation and verification;
*The parties refuse to cooperate with the investigation and verification process;
* There are other situations that need to be investigated and verified.
For personal inquiries, if no criminal record is found for the applicant, the receiving unit shall issue a "Certificate of No Criminal Record" (see Annex 3.docx); if the applicant is found to have a criminal record, a "Notice of Non-Issuance of Certificate of No Criminal Record" (see Annex 4.docx) shall be issued. If the applicant has a criminal record, but was under the age of 18 at the time of the crime and was sentenced to a term of imprisonment of less than five years, the receiving unit shall issue a "Certificate of No Criminal Record" (see Annex 3.docx).
(1) If you disagree with the results of the inquiry, you may apply for a review at the original receiving unit and submit a "Re-examination Application Form" (see Annex 2.docx). When the receiving unit conducts a review, the applicant must cooperate with the public security authority concerned during the review process.
(2) The re-examination result shall be provided in writing by the original receiving unit, under the name of the public security sub-bureau, within 15 working days of accepting the application. If the case is complex and cannot be resolved within the specified time-frame, the period may be extended with the approval of the head of the public security sub-bureau. The applicant must be notified, and the extension shall not exceed 30 working days.
(3) Upon re-examination, if the "Certificate of No Criminal Record" (see Annex 3.docx) and the "Notice of Non-Issuance of Certificate of No Criminal Record" (see Annex 4.docx) are found to be incorrect, the original issuing unit or its superior public security authority shall promptly revoke them and reissue the relevant documents.
(4) If the applicant believes that the court judgment on which the decision was based is erroneous and meets the legal criteria for appeal, the receiving unit may inform the applicant to file an appeal with the relevant court or procuratorate in accordance with legal procedures.
(1) For any individual who applies for the inquiries more than 3 times (not including 3 times) in a natural year, he/she shall submit relevant materials proving that the applications are used for reasonable purposes. If there are other special circumstances, you can consult the National Immigration Administration's 12367 hotline. The requirements for the materials proving the reasonable purposes of criminal record inquiries are as follows:
Application documents must be authentic, complete, clear, and neatly prepared, and must be signed and stamped by the registrant (specifically, the documents can be sealed by the registrant, or signed by the registrant's legal representative or person in charge and stamped with the company seal. The seal must be the registrant's official seal, and the registration seal shall not be used.)
Except for the supporting documents, all application materials should be provided in Chinese;
Forms completed and materials prepared by enterprises must be printed on A4 paper. Original documents issued by governments or other institutions should be submitted in their original sizes;
If photocopies of the application materials are required, the photocopies must be legible and marked with the date and the registrant's signature and seal;
The left margin of all application materials should generally be at least 20mm (for file binding);
The content should include the phrases such as "no criminal record in China" and "background investigation".
(2) The "Certificate of No Criminal Conviction" (see Annex 3.docx) or the Notification of Refusal to Issue a Certificate of No Criminal Conviction (see Annex 4.docx) must be signed for by the applicant or trustee.
(3) The criminal record query is based on the Ministry of Public Security's criminal information query platform and other relevant information query platforms. The query results only reflect the information available and entered in the platform at the time of the query.
(1) No individual shall apply for an inquiry of criminal records, forge or alter the Certificate of No Criminal Conviction (see Annex 3.docx) by means of fabricating facts, concealing the truth, providing false materials, fraudulently using identities, etc. If an individual violates the relevant laws and regulations in carrying out an inquiry of criminal records and causes serious consequences, the individual shall be investigated for personal responsibility according to law; and if a crime is constituted, criminal responsibility shall be investigated according to law.
(2) The inquiry shall be carried out in strict accordance with the prescribed procedures, and the relevant criminal information obtained through inquiry shall be kept confidential and shall not be disseminated or used for other purposes. Acts of violating relevant laws and regulations shall be investigated for corresponding responsibilities according to law; and acts that constitute crimes shall be investigated for criminal responsibilities according to law.
