Notice on Further Regulating the Purchase of Commercial Housing by Foreign Individuals 

Jing Jian Fa〔2015〕207

To the commission of housing and urban-rural development (housing administration) of each district, the land and real estate bureau of the economic and technological development zone, the public security sub-bureau of each district, and all the real estate developers and real estate brokers:

According to Notice on Further Regulating the Administration of Purchase of Housing by Foreign Organizations and Individuals' (Jian Fang〔2010〕186), Notice on Regulating the Purchase of Commercial Housing by Foreign Organizations and Individuals (Jing Jian Jiao〔2007〕103) and Notice on the Implementation of Beijing Municipality's Policy of Housing Purchase Restriction (Jing Jian Fa〔2011〕65), in order to further regulate the purchase of housing by foreign individuals and improve the government's work efficiency and service level, the relevant particulars are notified as follows:  

 I. Prior to purchasing any commercial housing in Beijing Municipality, the foreign individual shall submit valid identification documents to the real estate developers, the real estate brokers, and the online signing agencies (such as the stocking house online signing counters of each district) in accordance with the Notice numbered Jing Jian Fa〔2011〕65 and the Notice numbered Jing Jian Jiao〔2007〕103, and apply to verify the housing purchase qualification.

II. After initial verification of the identification documents by real estate developers, real estate brokers, and online signing agencies (such as the stocking house online signing counters of each district), the foreign individual shall give relevant information to the Beijing Real Estate Transaction Registration System, submitting an online application for verification of housing purchase qualification to Beijing Municipal Commission of Housing and Urban-rural Development and filing the application materials required under the Notice numbered Jing Jian Fa〔2011〕65.

III. Beijing Municipal Commission of Housing and Urban-rural Development and Beijing Municipal Public Security Bureau will jointly verify the housing purchase qualification of foreign individuals within 10 working days. The results of verification can be checked on the Beijing Municipal Commission of Housing and Urban-rural Development website. Foreign individuals who have passed the verification can proceed with the online signing procedure.  

Foreign individuals who disagree with the results of verification can apply for re-verification at Beijing Municipal Commission of Housing and Urban-rural Development upon presenting relevant identification materials.

IV. This Notice shall come into effect as of June 1, 2015. Since the effective date, the Beijing Municipal Public Security Bureau will no longer issue the Certificate of Residence Status of Foreign Individuals in China (hereinafter as the “Certificate”) in paper form; foreign individuals who have applied for verification of housing purchase qualification for the first time and passed the verification will not be required to present the Certificate for online signing, and no Certificate in paper form will be put on file at each housing registration department in any subsequent transfer registration. However, foreign individuals who have completed online signing before that date shall follow the original regulations in any subsequent transfer registration.
