Notice on Inviting Applications for Permanent Residence in China under the   Points System from Foreign Members of Start-up Teams as well as  Employed Foreign Management/ Technical Personnel in the Demonstration Area of Comprehensive Pilot Program for Further Opening up Beijing's  Service  Sector (2019)

To all units concerned,

To further promote the comprehensive pilot program for further opening up Beijing's service sector, strengthening the protection of foreign talent, and forming a new advantage to gather talent for the international development of Beijing's service sector, we have officially started to assess and invite applications for permanent  residence in  China under the points system from foreign members of start-up teams, as well as foreign management/technical personnel employed by enterprises, in the demonstration area of comprehensive pilot program to further open up Beijing's service sector in 2019.  Related notice is given as follows:  

I. Eligible Applicants

Two   groups of foreign talent are eligible for the permanent residence   application under the points system, including foreign members of   start-up teams and foreign management/technical personnel employed by   enterprises in the Chaoyang District and Shunyi District

(I)   Foreign members of start-up teams in the service sector of the   demonstration area of comprehensive pilot program for further opening  up  Beijing's service sector:

1. A start-up team shall meet the following criteria: 

(1)   The company founded by the team shall be registered in Chaoyang   District or Shunyi District and have paid taxes for no less than 5   years;

(2) The   company's business belongs to the service industries that conform to  the  urban strategic orientation of Beijing and are strongly promoted by  the  district government, including S&T, Internet information,  finance,  education, cultural tourism, medical care & pension,  professional  services, commercial services, etc. 

2. A foreign member of a start-up team shall meet one of the following criteria to be an eligible applicant:

(1) The member shall hold a director or above management post in the company;

(2) The member shall hold at least 5% or more of the shares in the company.

(II)   Foreign management and technical personnel employed by the service   industry enterprises in the demonstration area of the comprehensive   pilot program for further opening up Beijing's service sector:

1.   The business of the service industry enterprises in the demonstration   area shall conform to the urban strategic orientation of Beijing and  are  strongly promoted by the district government, including S&T,   Internet information, finance, education, cultural tourism, medical  care  & pension, professional services, commercial services, etc.; 

2.   The foreign management/technical personnel employed by the enterprises   in the demonstration area shall meet one of the following criteria:

(1)   Management/technical personnel who hold a director or above post in  the  above eight types of enterprises, or personnel with deputy senior  title  or above;

(2) Heads of special project teams or major projects;

(3) Professionals in short supply and urgent need in the industry.

II. Assessment Standards

For  Assessment Standards for Applications for Permanent Residence in China  under the Points System from Foreign Members of Start-up Teams in the  Service Sector in the Demonstration Area of Comprehensive Pilot Program  for Further Opening up the Service Sector in Beijing, and Assessment  Standards for Applications of Permanent Residence in China under the  Points System from Foreign Management and Technical Personnel Employed  by Enterprises in the Demonstration Area of Comprehensive Pilot Program  for Further Opening up the Service Sector in Beijing,  please see Annex  3.

III. Application Materials and Requirements

(I)   Foreign members of start-up teams in the demonstration area shall   submit the following materials for the application of permanent   residence in China under the points system:

1. An application from the employer;

2. A letter of commitment from the employer;

3. A letter of commitment from the applicant;

4.   A duly completed copy of the Application for Permanent Residence in  China under the Points System from Foreign Members of Start-up Teams and  Foreign Management and Technical Personnel Employed by Enterprises in  the Demonstration Area of Comprehensive Pilot Program for Further  Opening up the Service Sector in Beijing;

5. A photocopy of the applicant's valid passport; 

6. A photocopy of the company's business license duplicate; 

7.   A photocopy of the employment contract indicating the applicant's   position in the company (if the applicant is applying as a company   holder, a copy of the company's Articles of Association kept on record   by Beijing Administration for Industry and Commerce shall be presented   indicating the company shares held by the applicant);

8. The applicant's proof of tax payment in Beijing; 

9. Other related materials, for instance:

Education   background: the applicant's diploma of the highest level of education   and certificates issued by the certification institution designated by   the Chinese embassy or consulate in the applicant's home country or the   Ministry of Education; 

Number   of years working in China: the applicant's proof of tax payment in   China or work permit (Employment Certificate for Foreigners and Foreign   Expert Certificate) and other materials that can prove the number of   years the applicant has worked in China;

Relevant   work experience: contracts with former employers or proof of  employment  (including the applicant's position, professional title, job   description, work seniority, and other related information), and proof   of former employers' qualification (e.g. employees of universities   listed in the QS World University Rankings are required to present the   QS World University Rankings list);

Innovation   products or core technologies owned by the start-up team: proof of IP   ownership (patents obtained or certificates of awards and honors) and   other materials;

Investments attracted: investment agreements and proof of investments being credited to account;

Company earnings: a statement issued by a third party (affixed with its official seal), stating the company's tax record;

Investments in other companies: investment agreements and proof of capital contribution.

10. Other necessary materials. 

Please   note that the application materials written in foreign languages are   supposed to be translated into Chinese by a qualified translation   company and affixed with the official seal of the employer prior to   submission.

(II)   Foreign management/technical personnel employed by service industry   enterprises in the demonstration area shall submit the following   materials for the application of permanent residence in China under the   points system:

1. An application from the employer;

2. A letter of commitment from the employer;

3. A letter of commitment from the applicant;

4.   A duly completed copy of the Application for Permanent Residence in   China under the Points System from Foreign Members of New Venture Teams   and Foreign Management and Technical Personnel Employed by Enterprises   in the Demonstration Area of Comprehensive Pilot Program for Further   Opening up the Service Sector in Beijing;

5. A photocopy of the employment contract indicating the applicant's position in the company;

6. A photocopy of the applicant's valid passport; 

7. A photocopy of the company's business license duplicate;

8. The applicant's proof of tax payment in Beijing; 

9. A photocopy of relevant certificates obtained by the company;

10. Other relevant materials, for instance:

Education   background: the applicant's diploma of the highest level of education   and the certificates issued by the certification institution designated   by the Chinese embassy or consulate in the applicant's home country or   the Ministry of Education; 

Number   of years working in China: the applicant's proof of tax payment in   China or employment permit (Foreign Expert Certificate) and other   materials that can prove the number of years the applicant has worked  in  China;

Relevant   work experience: contracts with former employers or the proof of   employment (including the applicant's position, professional title, job   description, work seniority, and other related information), and proof   of former employers' qualification (e.g. employees of universities   listed in the QS World University Rankings are required to present the   QS World University Rankings list);

Gross   annual salary: a document issued by the employer proving the   applicant's salary plus performance bonus of the previous year;

Expertise   in technology: proof of IP ownership (patents obtained or certificates   of awards and honors), internationally recognized certificates in   professional or technical skills, and other related materials;

Social benefits: certificates of honors obtained, reports of public welfare activities carried out and other related materials.

11. Other necessary materials. 

Please note that:

1. The applicant must accept an interview if the accepting department deems it necessary; 

2.   The originals of application materials shall be submitted for   inspection, and the copies shall be stamped with the official seal of   the employer;

3.   Application materials written in foreign languages are supposed to be   translated by a qualified translation company into Chinese and affixed   with the official seal of the employer prior to submission.

IV. Requirements for Assembling Documents 

(I)   All application materials shall be bound and submitted on a company   basis and affixed with the official seal of the employer (requirements:   front-page seal + across-page seal). The originals of materials are   required to be delivered.  

(II)   Foreign members of start-up teams in the service sector and foreign   management/technical personnel employed by service industry enterprises   are two different categories of talent; therefore, their application   materials must be bound separately.  

(III)   For each category of applicants, the employer shall arrange  application  documents in the right order, i.e. the table of contents,  the summary  sheet of all applicants, the Application Form, and relevant  application  materials. Please use a color page to separate the  documents of  different applicants. Both the front and back covers shall  be sheets of  110-gram (or above) white matte cardstock paper.

(IV)   All application materials shall be submitted in five hard copies   together with a disc bearing the scanned copies in a compressed file.   The file shall be named after the employer name.
