Overseas Arbitration and Dispute Settlement Institutions Permitted to Establish Business Offices in China (Beijing) Pilot Free Trade Zone

Target group

    Nonprofit arbitration institutions that are legally established in foreign countries, and the Hong Kong Special Administrative Region, the Macao Special Administrative Region, and Taiwan Region of China, as well as arbitration institutions established by international organizations where China has joined as a full member.

Application conditions
  • Legally established in overseas regions;
  • More than 5 years of actual experience in arbitration and relevant dispute settlement;
  • High prestige in the industry and strong international influence;
  • Soon-to-be-appointed head of the business office has full capacity for civil conduct according to provisions of Chinese laws, without any record of criminal punishment for intentional crime;
  • Soon-to-be-appointed head of the business office serves as a full-time staff who along with other staff does not hold office in any other institutions;
  • To identify the prestige and international influence of an overseas arbitration institution, several factors will be taken into account, including the number and amount of closed cases, the international level of such cases, and ranking released by authoritative journals, newspapers, and assessment bodies in the international arbitration field, in addition to professional evaluation by industry experts.
Application procedures
  • To apply for establishing business offices in China (Beijing) Pilot Free Trade Zone, eligible overseas arbitration institutions shall submit the letter of application and application documents to Beijing Municipal Bureau of Justice (Address: Beijing Municipal Government Service Center, No.1 West 3rd Ring South Road, Fengtai District; Contact Number: 8610-89150405).
  • Within 5 working days after receipt of the application documents, Beijing Municipal Bureau of Justice shall notify the applicant of the acceptance or rejection decision, or notify the applicant of a complete list of required documents for supplementation and correction. Within 20 days as of the official acceptance, Beijing Municipal Bureau of Justice will make a decision on whether or not the registration is approved. Within 10 workdays as of the decision on registration, Beijing Municipal Bureau of Justice shall put the registration matters on record with the Ministry of Justice, which will later determine the uniform social credit code. After that, Beijing Municipal Bureau of Justice will grant the registration certificate to the business office.
  • Within 3 months as of the receipt of the registration certificate, the business office shall submit the following documents to Beijing Municipal Bureau of Justice for record purposes.
