Rules of Beijing Municipality for
Online Query of Real Estate Registration Information(Trial)

Article1 In line with Property Law of the People's Republic of China, Interim Regulation on Real Estate Registration, Interim Measures for the Consultation of Real Estate Registration Materials, the Detailed Implementation Rules for Querying Beijing Real Estate Registration Data(Trial)and other regulations, these Rules are hereby formulated in a view to guaranteeing the security of real estate transactions, protecting the legitimate rights and interests of real estate owners and related parties, further providing high-quality and efficient services, and standardizing the online query of real estate registration information.

Article2 The online query rules of real estate registration information shall follow the lawful, convenient, efficient, prudent and sharing principles.

Article3 Beijing Municipal Commission of Planning and Natural Resources supervises and directs the online query of real estate registration information across the whole city, and is responsible for the operation and maintenance of the online query system. The real estate registration service centers of each district are responsible for the online query of real estate registration information in the respective district.

Article4 The query applicant shall make inquiries after registration and real-name verification through the online service platform of property registration.
If the applicant is a natural person, he/she should enter his/her name, ID number and other relevant information on the registration interface, and upload the original copy of valid ID.
If the applicant is a non-natural person (e.g. a legal person or other organization), it should fill in the name, unified social credit code and other relevant information, and upload the business license, authorization letter and the original copy of trustee's ID.

Article5 The inquiry applicant logs into the query system, select and fill in relevant information in line with needs for inquiry.

Article6 Inquiry applicants can obtain the inquiry results immediately(the samples refer to Schedule 1 and Schedule 2), unless otherwise as stipulated.

Article7 Any inquiry applicant may inquire for the following information:

1.Information on the natural conditions of real estate;

2.Whether there is joint ownership on the property;

3.Whether there are the mortgage registration, the advance notice registration or dissidence registration;

4.Whether there are seizure registration or other restrictive punishment.

Article8 If the applicant is an obligee or an interested party, the following information can be queried:

1.Information on the natural conditions of real estate;

2.Information on the status of related rights;

3.The status of joint ownership;

4.The circumstance of the mortgage registration, the advance notice registration or dissidence registration;

5.The seizure registration or other restrictive punishment.

Article9 Any inquiry applicant can use the following retrieval information for inquiry:

1. The location of real estate;

2. Certificate No. of real property ownership;

3. The real estate unit number.

If the applicant is the obligee, it can also use the specific body's identity information such as name or title, ID number or unified social credit code.

Article10 When completing the inquiry conditions, the specific location of the real estate, the certificate number of the real property ownership and the unit number of the real estate should be identical with the information recorded in the real property certificate. Otherwise, the correct inquiry results cannot be displayed. The registration information of real estate shall be based on the information recorded in the real estate register.

Article11 For the inquiry applicants who have interests in the sale, exchange, gift, lease and mortgage of real estate, they should upload related materials such as sales contract, lease contract, swap contract, mortgage contract and gift contract.

The applicant for inquiry who has an interest in real estate due to civil disputes and has initiated litigation or arbitration shall upload such materials as the notice of acceptance of a case with an interest in real estate or the notice of acceptance of arbitration.

If the spouse of the obligee inquires about the real property acquired by the obligee during the marriage, he or she shall upload the marriage relationship documents. Article12 Stakeholders upload and submit scanned copies of the original documents. The inquiry department shall conduct online pre-examination based on the materials. The pre-examination shall be completed within 1-3 working days (The sample refers to Appendix 3). If the pre-examination is passed, the applicant may take the original uploaded documents to the inquiry department of the registration center in the area where the real estate is located. After checking the original documents and the uploaded data are identical with the original copy, the application will receive the inquiry results. If the pre-examination is not passed, the applicant shall be informed of the pre-examination results and the materials that need to be uploaded.

Article13 Query results are tabular, stamped with electronic inquiry seals and printable.

Article14  If the inquiry result is found to be incorrect, the applicant may bring his identity card and relevant real estate registration data to the registration center inquiry department where the real estate is located for on-site verification.

Article15 The inquiry applicant shall use the inquiry results according to the inquiry purposes, and shall disclose neither the registration information of the real estate, nor use the registration information of the real estate for other purposes.

Article16 The inquiry of secret real estate registration information shall be subject to the relevant state confidentiality provisions.

Article17 No fee is charged for online application and inquiry.

Article18 These Rules shall be interpreted by Beijing Municipal Commission of Planning and Natural Resources, ffective as of 2019.
