Measures for Credit Management of Survey and Design Quality for Low-Risk Projects (Trial)
Article 1 These Measures are formulated to ensure the survey and design quality and safety of low-risk projects in Beijing, create an effective in-process and ex-post supervision model featuring "random inspections and prompt release of results", and implement credit supervision over survey and design agenciesentities and their employees in the city.
Article 2 The Beijing Municipal Commission of Planning and Natural Resources is responsible for supervision and inspection over survey and design quality for low-risk projects in Beijing. The commission authorizes a construction drawing review agencyentity to carry out ex-post inspection of survey and design quality using the "Internet Plus" model whereby random inspections are implemented and results are promptly released.
The construction drawing review agencyentity is determined by random selection.
Article 3 The low-risk projects mentioned in these Measures include all internal renovation projects, as well as new construction and expansion projects for which a single building has an above-ground floor area of less than 5,000 m2 and an underground floor area of less than 2,000 m2, except for crowded places and special construction projects specified in Article 13 and Article 14 of the Provisions on Supervision and Administration of Fire Protection of Construction Projects (No. 119 Order of the Ministry of Public Security No. 119).
For low-risk projects that are not subject to prior review in Beijing, the survey and design agenciesentities shall undertake that the survey reports and construction drawing design documents conform to national and local standards.
Article 4 The Beijing Municipal Commission of Planning and Natural Resources shall carry out an ex-post inspection on the survey and design quality of low-risk projects every two months. Projects to be inspected are randomly selected from those in the low-risk "one-stop" service system that have obtained construction permits. The inspection proportion is determined according to the nature and scale of the projects (see Appendix 1) and shall be adjusted according to the inspection results of the previous year.
Article 5 The ex-post inspection of survey and design quality focuses on structural safety, fire safety and other aspects related to public interests and public safety (see Appendix 2 for the inspection points).
Article 6 After determining the projects to be inspected, the Beijing Municipal Commission of Planning and Natural Resources shall ask the survey and design agenciesentities to submit online their survey reports or construction drawing design documents to be inspected, and authorize a construction drawing review agencyentity to carry out technical inspection. Any agencyentity that fails to submit required documents in time will be listed as loss of credibility.
Article 7 The construction drawing review agencyentity shall inspect the contents of the survey reports or construction drawings concerning public interests and public safety according to the inspection points, and truthfully report the inspection results to the Beijing Municipal Commission of Planning and Natural Resources.
Article 8 The Beijing Municipal Commission of Planning and Natural Resources shall inform the inspected agenciesentities of the inspection results. An inspected agencyentity that has any objection to the inspection results shall file an application for double check with the Beijing Municipal Commission of Planning and Natural Resources within 5 working days upon receipt of the inspection results. The commission shall organize more than 3 experts in this profession to double review the results, and the final conclusion shall be subject to the double check results.
Article 9 The Beijing Municipal Commission of Planning and Natural Resources shall issue a Notice of Survey and Design Rectification to the survey and design agenciesentities concerned according to the final inspection results. The commission shall, in accordance with the law, impose administrative penalties on the relevant survey and design agenciesentities that are found to have violated the mandatory standards of construction during the inspection.
Article 10 The survey and design agenciesentities shall immediately make rectification according to the Notice of Survey and Design Rectification and report the rectification to the Beijing Municipal Commission of Planning and Natural Resources for the record.
Article 11 The Beijing Municipal Commission of Planning and Natural Resources shall send a copy of the inspection results to the Beijing Municipal Commission of Housing and Urban-Rural Development which shall urge the contractors construction entities to implement rectifications in accordance with the revised design documents during the project implementation.
Article 12 The inspection results shall be published regularly on the website of the Beijing Municipal Commission of Planning and Natural Resources. The disclosed contents shall include the time of inspection, the contents of inspection, the inspected agenciesentities, project leaders, profession leaders, the inspection results, and the handling suggestions.
Article 13 The Beijing Municipal Commission of Planning and Natural Resources shall be responsible for supervising and assessing the inspection quality of the review agencyentity.
Article 14 The Beijing Municipal Commission of Planning and Natural Resources shall implement quality credit score management for survey and design agenciesentities, project leaders and profession leaders, conduct quality credit rating and punishment for relevant agenciesentities and personnel, and publish and rank them on the website of the commission.
Article 15 The scoring period starts from January 1 to December 31 each year. The initial points of an agencyentity or a person start from 100 points each year. When the scoring period ends, the annual points of the agencyentity or the person will be re-scored. For any agencyentity not inspected during a year, its score is 0.
Article 16 According to the inspection results, the Beijing Municipal Commission of Planning and Natural Resources shall deduct points from the concerned survey and design agenciesentities, project leaders and profession leaders.
1. Each violation of mandatory construction standards will result in a deduction of 6 points, and included in the quality credit score for the current year and the next year.
2. Each serious violation of safety which does not involve mandatory construction standards will result in a deduction of 4 points.
3. Each violation of general regulations will result in a deduction of 2 points.
4. Three points will be added to a project where no above problems are found.
Article 17 The Beijing Municipal Commission of Planning and Natural Resources shall deal with survey and design agenciesentities as follows according to their scores:
1. When 25 points are deducted, an agencyentity will be rated as minor loss of credibility. The agencyentity will be interviewed and subject to a more frequent inspection of its projects.
2. When 35 points are deducted, an agencyentity will be rated as ordinary loss of credibility. The agencyentity will be asked to make rectification for three months, during which the agencyentity's bidding for survey and design and construction drawing review in the city will be suspended.
3. When 50 points are deducted, an agencyentity will be rated as serious loss of credibility. The agencyentity will be asked to make rectification for six months, during which the agencyentity's bidding for survey and design and construction drawing review in the city will be suspended.
Article 18 The Beijing Municipal Commission of Planning and Natural Resources shall deal with project leaders and profession leaders of design and survey agenciesentities as follows according to their scores:
1. Project leader
i. When 20 points are deducted, a project leader will be rated as minor loss of credibility. The person will be interviewed and subject to a more frequent inspection of his/her projects.
ii. When 35 points are deducted, a project leader will be rated as ordinary loss of credibility and shall not be appointed as project leader within three months.
iii. When 50 points are deducted, a project leader will be rated as serious loss of credibility and shall not be appointed as project leader within six months.
2. Profession leader
i. When 15 points are deducted, a profession leader will be rated as minor loss of credibility. The person will be interviewed and subject to a more frequent inspection of his/her projects.
ii. When 30 points are deducted, a profession leader will be rated as ordinary loss of credibility and shall not be appointed as profession leader within three months.
iii. When 50 points are deducted, a profession leader will be rated as serious loss of credibility and shall not be appointed as profession leader within six months.
Article 19 The Beijing Municipal Commission of Planning and Natural Resources shall inform the relevant agenciesentities and individuals of the credit scores and the levels of loss of credibility by SMS or in writing. Any agencyentity or individual having any objection to the scores shall appeal to the commission in writing within 10 working days.
Article 20 The credit records of agenciesentities and individuals shall be published the website every year, and the duration of publicity shall be determined according to the level of loss of credibility:
1.Minor loss of credibility: 6 months;
2.Ordinary loss of credibility: 1 year;
3.Serious loss of credibility: 2 years.
Article 21 The Beijing Municipal Commission of Planning and Natural Resources shall strictly abide by the rules and regulations, observe the work discipline, administer the work according to the law and enforce the law honestly in the course of carrying out the quality inspection based on random inspections and prompt release of results as well as the credit supervision over the survey and design of low-risk projects.
Article 22 The trial period of these Measures will end at December 31, 2020, upon which these Measures will be revised according to the actual situation for formal implementation.
