Implementation Proposal of Dongcheng District to Carry out the "Work Plan of Fully Promoting Comprehensive Pilot Program for Further Opening up the Service Sector in Beijing"

In order to implement the "Work Plan of Fully Promoting Comprehensive Pilot Program for Further Opening up the Service Sector in Beijing" ( GH[2019] No. 16) approved by the State Council, actively promote the actualization of a new round of opening-up measures and enable a higher level of opening-up of the service industry in Dongcheng District, this Proposal is hereby formulated on the basis of actual situation in the district.

I. Overall Requirements

Following Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, we shall fully implement the guiding principles of the Party's 19th National Congress , and the second and third plenary sessions of the 19th Central Committee, adhere to the general principle of  pursuing progress while ensuring stability, apply the new development philosophy, and promote high-quality development by continuation of the supply-side structural reform as our main task so as to build a "high-grade, precision and advanced" economic structure and a new open economy. Situated in one of the "Four Centers", the functional positioning of the capital, and in alignment with international advanced rules, we shall press ahead with reforms to streamline administration so as to create a world-class business environment. In accordance with the requirements of the Work Plan of Fully Promoting Comprehensive Pilot Program for Further Opening up the Service Sector in Beijing, we shall accelerate the creation of a demonstration zone of national cultural and financial cooperation, push forward further opening-up in key areas and strive to gain more replicable and transferable experience in further opening-up of service sector, making contribution to the construction of a world-class harmonious and livable capital.

II. Main Tasks and Division of Work

(I) Taking advantage of its location as the political center, we shall further strengthen the service guarantee capability.

1. We shall serve the overall plan and make all efforts to provide service guarantees for major national activities.

2. We shall effectively prevent and resolve major risks, strengthen the construction of a financial risk monitoring and early warning system, improve the regulatory system, and maintain stability in the district.

3. We shall implement Beijing's Big Data Action Plan. By  means of related data interconnection, opening and sharing of public security (exit-entry administration), market supervision, customs, commerce, transportation and financial supervision, we shall promote the construction of a smart city, improve the overall risk assessment and early warning system of city operation for national security needs and capabilities of emergency response and precise governance in an all-around way so as to efficiently guarantee the security of national governmental affairs.

(II) Basing ourselves in the construction of capital cultural center, and enhancing our cultural soft power and international influence.

4. We shall pilot the exploration of measures to increase foreign investment in the cultural field in free trade zone policies.

5. We shall adhere to the integration of further opening-up and strong supervision, resolutely guard the bottom line of safety, and strengthen the supervision in process and afterwards in the cultural market.

6. We shall improve the international exchange and cooperation mechanism in the cultural field, expand channels, build a platform for cultural exhibition and exchange, and cooperate with Beijing Overseas Chinese Cultural Exchange Center on the construction work to orderly introduce outstanding foreign cultural achievements.

7. We shall actively promote cultural exchanges with countries involved in the "Belt and Road Initiative (BRI)" and deepen cultural exchanges between sister cities.

8. We shall embrace the cultural enterprises that set up joint venture publishing companies and artwork operations overseas.

9. We shall organize or assist in organizing a series of brand cultural activities such as the "Global Tour of Temple Fair at the Ditan Park ", Beijing International Design Week, and Beijing International Book Carnival.

10. We shall focus on the development of cultural trades such as cultural information, creative design, games and animation copyright, push forward the overall export of "Culture +"supported by digital technology and guided by high-end services, and actively participate in the construction of or construct national cultural export bases, and Chinese medicine cultural tourism demonstration bases, etc.

11. We shall explore the establishment of a cultural development fund, explore innovations in financial services for cultural trade, and actively create new cultural business forms.

12. In order to promote international exchange and cooperation, we shall perform with targeted and differentiated management practices to editors, composers, performers and marketers engaged in cultural export business of state-owned cultural enterprises, as well as teachers of related subjects at vocational colleges (including technical colleges),who go abroad for business.

(III) Focusing on the construction of the capital as an international exchange center, and continuing the optimization of the physical and soft-power environment for international exchange.

13. We shall actualize the visa system for foreigners seek medical treatment in China.

14. We shall relax the application criteria for the establishment of investment companies of foreign investors. The required amount of total assets of a foreign investor in the preceding year of application is reduced to be not less than US $ 200 million. The upper limit for the number of foreign-invested enterprises established by foreign investor in China is canceled.

15. We shall eliminate the requirement that the foreign investor should obtain the approval of a recognized accreditation body in their country or region and have more than 3 years of business experience in accreditation related activities when the foreign-invested enterprise applies for the qualification of being an accreditation body in China.

16. We shall further seek ways and mechanisms for closer business cooperation between Chinese domestic law firms and overseas law firms (including law firms in Hong Kong, Macao and Taiwan). In the pilot program hiring foreign lawyers as foreign legal advisers in domestic law firms, we shall, as appropriate, lower the qualification criterion that the foreign lawyer participating in the pilot program must not have less than 3 years' experience of legal  practices outside China.

17. We shall actively participate in the China International Fair for Trade in Services to help enhance the brand image and international influence of Beijing's convention and exhibition industry.

18. We shall make efforts for the success of the annual meetings and exhibitions of international organizations to enhance the brand image and international influence of Beijing's exhibition industry.

19. We shall implement Beijing's three-year action plan to promote the construction of the "Belt and Road Initiative".

20. We shall continue to promote the construction of Beijing B&R International Co-incubation (ICI) and build technology innovation parks together with the countries involved in the Initiative.

21. We shall seek establishment of closer cooperation mechanisms with Hong Kong and Macao to jointly develop markets covered by the "Belt and Road Initiative."

22. We shall encourage enterprises with proprietary brands and intellectual properties to develop international markets, increase international economic and trade cooperation, and help build a network of global economic and trade cooperation service centers in Beijing.

(IV) Assisting in the construction of a science and technology innovation center in the capital and building a world-class innovation and   entrepreneurial ecosystem.

23. With policy measures encouraging the development of R&D centers of multinational companies, we shall accelerate the convergence of international R&D centers and high-end talents.

24. We shall encourage enterprises in Dongcheng District to set up R&D institutions overseas, accelerate the layout of overseas intellectual properties, participate in research and formulation of international standards, and expand overseas market.

25. We shall promote the implementation of policies such as  offering preferential personal income tax for the cash reward turned from scientific and technological achievement.

26. We shall actively encourage enterprises in the district to apply for coverage of national, Beijing, and Zhongguancun policies that fund enterprises applying for intellectual properties abroad.

27. We shall improve the operation of SME(Small Medium Enterprise) development funds and the construction of public service platforms for SMEs.

28. We shall explore intellectual property securitization.

(V) Promoting the coordinated development of Beijing, Tianjin and Hebei, and build a new pattern of regional collaborative opening-up.

29. We shall jointly seek a model of investment invitation and cooperation in the Beijing-Tianjin-Hebei industry chain.

30. We shall carry out the pilot program of the medical device registrant system, allowing Beijing medical device registrants to entrust medical device manufacturers in Beijing, Tianjin and Hebei to produce medical devices, so as to promote the development of the "registration + production"cross-regional industrial chain.

31. We shall cooperate on the construction of the Beijing-Tianjin-Hebei intellectual property protection system, give full play to the advantages of high-quality intellectual property service resources in Dongcheng District, and encourage intellectual property service agencies in the district to provide intellectual property services to Tianjin and Hebei enterprises.

32. We shall implement the coordination and cooperation in enterprise credit information management, application and other links.

(VI) Strengthening the financial service function and contributing to national financial reform, opening-up and innovation.

33. We shall strive to build a frontier area for international financial opening-up, increase the attractiveness of the district to foreign financial institutions, and push forward the prioritized implementation of the fruits brought by financial industrial opening-up.

34. Centering upon the creation of a national culture-finance cooperative demonstration zone, we shall try first in cultural and financial policy innovation.

35. We shall gather and strengthen the financial service industry, make good use of the further opening-up policy for the service industry, and introduce new branches of key domestic and foreign financial institutions.

37. We shall guide all types of capital into fields such as culture and tourism.

38. Focusing on Chinese medicinal health care, we shall actively develop the trade in Chinese medicine services to bring in a new industrial form with an integrated development of rehabilitation, fitness, health, and leisure tourism.

39. We shall allow foreign-owned travel agencies in Beijing to pilot the operation of outbound tourism business for Chinese citizens (except for going to Taiwan).

40. We shall implement the tax policy for duty-free shops in the city.

41. We shall explore innovative regulatory models for new business forms such as unmanned supermarkets (convenience stores).

42. We shall actively carry out the uniform work deployment of Beijing, and explore the development of "Internet + medical health"service.

43. We shall improve the administration and service mechanism for foreign-invested enterprises, optimize the filing and registration of foreign-invested enterprises, and innovate the implementation mechanism for foreign-invested projects.

44. We shall establish a sound supervision in process and afterwards, which is compatible with the negative list management method.

48. We shall actualize Beijing's three-year action plan for further optimizing the business environment and carry out the Action Plan for Further Optimizing the Business Environment in Dongcheng District (2018-2020).

49. We shall deepen the reform of commercial system and the reform of "integration of multiple certificates" and "separation of business certificate and license".

50. In terms of enterprise registration, we shall create the "e registration" application model, pursue fully electronic application, and comprehensively promote the application of electronic business license to greatly improve the efficiency of starting a business.

51. We shall work to streamline the registration of enterprise changes.

52. We shall find ways to further optimize de-registration procedure by streamlining it. We shall expand the scope of its application, reduce the period an announcement  is put out, establish a fault tolerance mechanism and explore the establishment of an online service zone for corporate de-registration via the integrated government service platform.

53. We shall advocate overseas layout of trademarks of resident enterprises in the district and strengthen the overseas protection of trademark rights.

54. The eligible "top, cutting-edge and rare" foreign talents hired by enterprises in service industry can  enjoy a range of convenience measures and "Green Channel" services including application of work permit, talent visa, and social security, etc. in accordance with the regulation of foreign talents(Category A), provided that they have been recognized by the competent department of foreign talents.

55. We shall promote the policy that allows foreign talents with permanent residence permits to enjoy national treatment in the establishment of technology-based enterprises.

56. We shall implement Measures on Deepening the Reform of Talent Management in Zhongguancun and Building an Internationally Competitive Talent Acquisition Mechanism, and apply the exit-entry management reform to foreign talents in comprehensive pilot demonstration zones for further opening up in the service sector.

57. We shall implement the social application of permanent residence permits for foreigners

58. We shall encourage employers to establish enterprise annuities for high-level foreign talents in accordance with relevant regulations.

59. When returning to home country at the end of their employment, foreign talents are allowed to withdraw social insurance funds paid in Beijing and terminate the social insurance  agreement, or retain the social insurance agreement for future accumulation as they come to work again in China.

60. We shall work on the construction of think tanks together with the municipal departments.

61. We shall implement competition policy, strengthen review on fair competition, reinforce the enforcement against monopoly and unfair competition, and eliminate all the regulations and practices that impede the  uniform market and fair competition.

62. We shall establish a sound complaint mechanism for foreign-invested enterprises to protect the legitimate rights and interests of foreign investors.

63. We shall intensify the penalties for intellectual property right violations and improve the multivariant resolution mechanism for intellectual property disputes.

64. We shall help build a credit supervision system centering on credit commitment, joint rewards and punishments, and information  announcement via the national credit information sharing platform and Beijing's public credit information service platform.

III.  Safeguard Measures

(I) Strengthening organization and leadership

We shall supplement leading units (hereinafter referred to as the Leading Group) of Dongcheng District for the Implementation of the Comprehensive Pilot Program for Further Opening up the Service Sector in Beijing in a timely manner according to the division of tasks for the Work Plan of Fully Promoting Comprehensive Pilot Program for Further Opening up the Service Sector in Beijing. We shall further give play to the role of the Leading Group in organizing, leading and coordinating, steadily promoting a new round of policy measures for further opening up the service sector. All units shall earnestly raise the awareness to attach great attention to the new round of work for the further opening-up. Main responsible leaders shall personally study, deploy, supervise and inspect the work. They shall set definite goals and highlight key points based on the actual situation, and ensure a detailed division of work task and assign definite responsibilities to relevant persons, so as to complete the fulfillment of the task.

(II) Improving working mechanism

We shall establish an urban coordination mechanism to actively seek support from municipal departments for the pilot work. We shall improve the mechanism of regular work meetings, convening work meetings in a timely manner according to district leaders' instructions and work needs, so as to strengthen work research and information communication, report achievements of the new round of work for further opening-up, and find ways to tackle issues in the pilot practice.

(III) Increasing policy publicity

It is necessary to fully realize that the comprehensive pilot program of further opening up the service sector in Beijing is an important measure to implement the new development concept, build a modern economic system, and promote the formation of a new pattern of all-round opening-up. All units shall conscientiously study and comprehend relevant policies, documents, and guiding principles of the comprehensive pilot program for further opening up the service sector in Beijing, and strengthen policy publicity and implementation by organizing policy training meetings, holding enterprise symposiums, visiting the demonstration sites, and exchanging views and experiences, etc.

(IV) Strengthening coordination with municipal departments

All departments must increase contact with superior departments, fully understand the connotation of each task, and actively implement  them. The leading departments of comprehensive economy and industry shall propose new issues waiting to be solved according to the needs of enterprises, which will be coordinated by the commerce department and done through communication with municipal departments.

(V) Establishing key enterprise library

Focusing on these open pilot areas such as education, medical and elderly care, science and technology, Internet information, finance, cultural and tourism, and professional services, we shall select representative enterprises to make a key enterprise library, follow up the enterprises accurately and provide them with one-to-one service, so as to accelerate the implementation of policy and achieve substantial effect as soon as possible. The member units shall report to the Leading Group office about the key enterprises in their charge, and dynamically test the implementation effect of the pilot measure with the key enterprises as tracking objects.

(VI) Putting greater emphasis on promoting the construction of demonstration parks

We shall push forward the construction of Wangfujing Street Service and International Exchanges Center. We shall propel further opening-up in Wangfujing area  and elevate the radiation and driving force of the service industrial development by starting from improving the ecological environment, creating a large international festival exhibition brand, building an international brands center, and creating a convergence for cultural consumptions to make an international service area with an integrated development of business and commerce, etc.
