Investment in preschools, high schools and institutions of higher education in China:

A preschool, a regular senior secondary school, or a higher education institution shall be restricted to Chinese-foreign contractual joint venture, under the control of the Chinese party (the principal or the chief executive shall be a Chinese citizen, and the council, board of directors, or joint management committee shall consist of members from the Chinese party accounting for not less than one half of the total number of members).

Investment in preschools, high schools and institutions of higher education within China (Beijing) Pilot Free Trade Zone:

Pre-school education institutions, regular upper secondary schools, and higher education institutions shall be limited to the form of Chinese-foreign cooperative schools, which must be dominated by Chinese investors (the principal or main administrative head should have Chinese nationality, and reside in China. Chinese members shall comprise no less than half of the Council, board of directors, or joint administrative committee). (Foreign educational institutions and other organizations or individuals shall not solely establish schools or any other educational institutions that are primarily open to Chinese citizens (excluding non-academic vocational training institutions, and academic vocational education institutions). However, foreign educational institutions may cooperate with a Chinese educational institution to jointly establish educational institutions mainly targeting Chinese citizens.)

Investment in a compulsory educational institution or a religious educational institution shall be prohibited

Investment in other education-related businesses in China:

No special requirements are specified for other businesses in the education industry in the Special Administrative Measures for the Access of Foreign Investment (Negative List).

More favorable access policies in Beijing:

Encourage foreign investment in adult education training institutions, and support foreign investment in funding and operating vocational skills training institutions.
Beijing Municipality is authorized to formulate and promulgate specific management measures on encouraging foreign investment in commercial adult education and training institutions and on supporting foreign investors in funding commercial vocational training institutions.
